just done talking with NVC and ask him about , Do i have to have updated i-864 and file a Tax return of 2015 at the time of interview? He told me that I don't have to have updated i-864 and file a tax return 2015 at the interview because my wife interview is April 15th and tax return deadline is April 18, so u will be fine. I also told him that I already file an extension and sent it to my wife with copy of w2, he said that that's not necessary, but it's ok u did it. They will not ask updated tax return information before the tax return deadline.

7 days after case complete. Maybe today or tomorrow. Really doesn't matter if you got confirmation via phone. That's what matters..

He called the IRS office and they told him either way is fine but he will amend it to Married filing separately.

I am posting here my reply to your PM for the benefit of all members:

First, I want to clarify I referred to the NVC process Wiki guide here in VJ, not to the official https://travel.state...s/approved.html

The Official NVC section of the State Department does not specify how you file taxes, it just requires an AOS.

Second, the NVC process Wiki guide: Item 14 addresses taxes issues: It shows examples of 2014 because it was written back then.

The 3 conditions to claim spouse exemption are NEW for 2015.

Filing MFS and using NRA in tyhe SSN field for immigrant spouse is nothing new.

This link proves that the IRS has provisions for non resident spouses living abroad.

BOTTOM LINE IS NOT TO LIE TO UNCLE SAM REGARDING YOUR CIVIL STATUS ON YOUR TAX RETURN.

FURTHERMORE, THE CO WILL DENY YOUR VISA OR PUT YOU ON AP UNTIL YOUR INCOME TAX REFLECTS YOUR REAL CIVIL STATUS, WHICH MUST BE MARRIED BECAUSE YOU ARE APPLYING FOR A IR1/CR1.

The CO does no care if you file MFJ (a little bit complicated) or MFS (easier this year, because of the 3 conditions), THE CO WANTS TO SEE "M" for MARRIED.

10-21-2015 My wife came to visit me on a B1/B2. No problems at POE Miami :P

11-04-2015 Received NOA2 via email. (56 days after NOA1)

11-08-2015 My wife ends visit and returns to Colombia to wait for interview :(

11-09-2015 Received I-797 via snail mail. (NOA2)

STAGE 2: NVC

11-16-2015 NVC received our case,(12 days after NOA2).

12-07-2015 Emailed inquiry to NVC to inform them my email. http://travel.state.gov/content/visas/en/contact.html

12-08-2015 NVC assigned case and invoice ID number,(34 days after NOA2) Case was assigned after 13:00 PM. I called at 12:30 then at 19:00 PM

12-08-2015 Completed Choice of Agent DS-261

12-09-2015 Received 2 emails with Welcome Letters for my wife and I, they were sent by ASKnvc@state.gov

12-09-2015 AOS bill became available and I paid it. (IN PROCESS)

12-12-2015 Mailed AOS and IV packages.

12-14-2015 Received via email IV bill from ASKnvc@state.gov and paid the IV fee.

12-14-2015 AOS fee updated to PAID

12-15-2015 USPS tracking shows AOS/IV packages were delivered to NVC. Waiting for a SCAN date.

12-16-2015 IV fee updated to PAID and completed DS-260

12-19-2015 Scan Date (45 days after NOA2). I called on 01-13-16 and I was told my scan date is 12-15-15????

01-26-2016 Case complete. (83 days after NOA2)

01-29-2016 Called NVC, I was informed my CO Interview will be on 03-01-2016 at 08:00.

02-02-2016 Received Interview Letter (P4) via email.

02-09-2016 Package picked-up by DHL at 15:29 Waybill 5992952011. CEAC status "IN TRANSIT"

STAGE 3: US Embassy Bogota

02-11-2016 US Embassy Bogota received my package at 10:39.

02-12-2016 CEAC Visa Status changed from "IN TRANSIT" to "READY"

02-24-2016 Lab exams at the clinic and Bio-metrics at the CAS center.

02-25-2016 Medical Exams.

03-01-2016 Interview Date (175 days after I mailed I-130) VISA APPROVED. CEAC status changed to AP

03-02-2016 Paid Immigrant Visa Fee via ELIS account. CEAC status changed to ISSUED

03-03-2016 US Embassy Bogota sends Passport and Visa package via DHL Waybill 2900131780 to Cali.

03-04-2016 My wife picked up at DHL sealed approved IV package and her passport with a stamped I-551 IV Category CR1.

My AOS fee now showing as paid.. Previously it was N/A. Case is at embassy.. Interview on 1st April.. Any idea??

seems like a checklist.. that's what happened to me. but i didn't get an interview date. maybe they want you to bring the documents with you to the interview.

I dont think its a checklist because case already completed at nvc and is now with embassy.. All necessary docs were submitted..

I thought so too when they told me it was a cc. but try to call tomorrow...or wait til the day of your interview

My case was completed on 2nd November 2015.. What documents did they asked for u in checklist??

original birth certificate which they could've asked a week before or asked me to bring it in to the interview. Pissed me off. I have contacted senators to get involved..

they gave me a checklist 5 days after they told me that I had the CC

ok.. then my case is different than urs.. bcoz my cc was almost 4 and half months back and till the time it was with nvc it showed as n/a only.. and now after coming to embassy it is switched to paid.. i think it must be a routine..
