Can I (UK citizen) marry my boyfriend (US citizen) on a tourist visa?

Hello, everyone.

My boyfriend and I have been together for 3 years and have discussed marriage for the past few months. We've decided that we want to live in America and would also like to get married in America. I plan to visit him in June and would like to know if it is legal for us to get married on my tourist visa, with the plan for me to go back to the UK whilst he files for the spouse visa. Is this legal? And if so, could you give me advice on the best way to do it, as I find it all confusing.

Also, a step-by-step plan would be hugely appreciated.

Yes, you can visit your fiance, get married and then go back home.

I would advise that you bring the relevant documents on your trip so you don't have to mail it to him afterwards.

If you look through the guide, it mentions documentation about previous marriages (if applicable), passport sized photos (which I guess you can take in the US), and signatures on the forms (this you can also do in the US).

I think the main thing is getting the signatures -- that way, you don't have to send forms back and forth. The other thing is evidence of the relationship which would be communications, pictures etc.

You and your fiance can probably prep the necessary forms and documents before you leave.

Oh thank you, you've been a huge help. I will be sure to write it all down.

Also, if you don't mind, sorry for all the questions, but once were married, do I have to come back to the UK the day after? A week after? Also, do I have to stay in the UK whilst the spouse visa is processing or can I visit him throughout the process?

A tourist/visitor visa is for visiting, an immigrant visa is for immigration. Since you have already expressed a desire to get married in the US while visiting your boyfriend, the legal method is to marry, then go home and file for a CR1 spousal immigrant visa.

To have the preconceived notion to visit, marry, and stay with your now-husband while on a tourist/visitor visa could be construed as immigration fraud, and you could face serious consequences should USCIS catch on to your scheme. That is why people are responding to you with the proper manner.
