I-751 in September, getting divorced.

Hi everyone, I applied for conditions removal in September, 2015. However, my wife has just confessed to me she was on an affair with another guy and even got pregnant. I cannot bear this fact and want to divorce before the baby is born. I know they are processing August cases for California Center, so it will be like a month or so to get my application processed. Meanwhile, I want to start on the divorce. I want to know if any body has had the same experience and how you dealed with it. Of course, I will talk to my attorney too, but more advice does not make it worse.

Since your wife is pregnant its gonna be complicated to get a divorce easly, sometimes the courts will wait till she gives birth to finalize the divorce, you can request from the court that she must do DNA test to see if the baby is yours or not, if it was yours, you might be ordered to pay alimony or child support. If that's the case then you have to wait till she gives birth, if by then you got your GC then you dont have to do anything because you are legally still married. If she gave birth and still didnt get your GC, then you can file for divorce and re-send another I-751 form with Divorce Waiver.

If you dont wish to stay with her till she gives birth, you can file for divorce and move to your own place, and send a new I-751 form with divorce waiver. The USCIS will send you RFE for the divorce decree, when you have it then forward a copy for them.
