Must US Entry be from Country where K-1 Issued?

Hi,

My fiancee is living and working in Thailand which is where the K-1 Visa will be issued from; however, she is from the Philippines.

We would really like, after the Visa is issued and before we come to the US to be married, to travel to the Philippines to celebrate with here family.

It's important to both of us that I meet her family and, hopefully, get the blessing from her father.

What this would mean, however, is that we would end up flying back from the Philippines to the US for her initial entry and not from Thailand where the K-1 Visa was issued.

Is this a problem or am I overthinking this?

Thank you for any help you can provide...

No problem, she can travel to the US from the Philippines and any other country as long as she has her visa.

The immigration process caused me PTSD.

Since not all countries has direct flights to the US it wouldn't work if they came up with a rule that said your flight had to be from the country your visa has been issued in. People get connecting flights. Your fiance is fine. :)

Not related to the issue of the visa as if she were from any other country this wouldn't be an issue. Don't all filipinas who are leaving on a K1 from the Philippines have to go through CFO process or is that just those who get their visa from the embassy in the Philippines?

I would ask this in the Philippines sub forum here just to check. CFO is a Philippine government process and not a us embassy process so it only applies to the Philippines

Oh yeah, now that you mention it. Don't they have to go on some kind of course to prepare themselves for life in the US for a few days before they're allowed to leave?

Your fiancee will have to attend the CFO GCP seminar, receive the certificate and get the CFO sticker in her passport. She will not be allowed to exit the Philippines without the CFO sticker, being she has the K-1 visa in her passport.

There is information on CFO within the link in my signature below

Wow... even though her K-1 visa is from Thailand, she will still need to do this?

Yes if she goes back to the Philippines before she immigrates to the USA. She then has to attend CFO before she can go to the USA, that is Philippine law.

Yup. Your fiancee is a Philippine citizen, traveling with a Philippine passport ... as the saying goes "can't leave home without it".

If you wait until later to return, as in after she has her green card, then no issue.

Thanks, again, everyone. My fiancee and I have decided not to go back to the Philippines until after we're married; the K-1 process is difficult enough without throwing more obstacles into the mix. :)

Well, it all depends on how long you will be in the Philippines. If you are there for a couple of weeks and are in either Cebu or Manila, then the process is just a day out of your stay there. The CFO is pretty easy but it depends on you.

CFO is a PITA at best... what I call a necessary evil. My wife easily cleared CFO and had her sticker; about 4 hours for the seminar/interview, another hour waiting for the sticker to be affixed in the passport.

When you return to the Philippines after completing AOS and having a green card, CFO will be of no concern.
