Got an RFE end of april, sent in ASAP. RFE recieved on May 11 and still no response or update to the i485 status since.

It was just for a birth certificate translation/i94. Do they always take this long to respond to an RFE??

I got a RFE and the USCIS updated my status to "RFE response was received on ..." shortly after receiving it.

Then, my status was updated to "Ready to be scheduled for an interview" since May 30th.

But you should not be worried. They do not update case status for every case though. I know it's annoying to see people's statuses got updated but not yours.

It doesn't hurt to call them though.

They're probably just too lazy to update it online as response received.

It says response recieved. I meant, what happens next? Response approved update? It shows response recieved on May 11 and that's the last update we got.

It says response recieved. I meant, what happens next? Response approved update? It shows response recieved on May 11 and that's the last update we got.

The i485 will go to case ready for interview or interview scheduled. It can take a while because it depends on your local office

Thanks. I thought it would go to some sort of response approved update but guess not; ready to schedule makes more sense.

A little bit. In my case it was,but yesterday at least I-131,I-765 was approved, almost 123 days... Thanks to a rfe.

Congrats on approval! I know it's a huge relief to be able to finally have but 123 days, wow.

Hi everyone!

Sad news :(

I received an RFE on my i-845 today, 4 MONTHS after the NOA and 3 after biometrics, what the hell?

It says that I need to submit:

- Original certified birth cert (even though instructions says photocopies unless otherwise specified)

- G-325A (which I submitted, dated and signed)

- It says the medical examination I paid a fortune for overseas was not completed properly and I now need to go pay another extortionate amount of money for another.

- Evidence of bona fides of marriage.

I'm especially worried about the last one because I only JUST received my ssn so I am awaiting my license so that we can go open a join bank account but other than that there really is nothing else we can use. We don't rent and the mortgage my husband had before we met so it's just his name on it. What other evidence did you guys send? It says you can get people to sign affidavits confirming the bona fides? Has anyone done this? If so who did you use? Work colleagues, family, friends etc?

I am so frustrated right now, I cannot believe it has taken them 4 months to inform me of this PLUS, I really don't know why the medical examination wasn't done properly, why I wasn't told this at the embassy overseas, why they're telling me I didn't submit form G325-A.

Also, anyone who has had an RFE and sent it back if you know, is it going to take them another 4 months to look at the stuff once we mail it? Am I going back to the bottom of the list? Otherwise it'll look like by the end of the year I'll have to be applying to extend my work permit because my GC will be nowhere near my mailbox!

If you sent the documents, they might have been misplaced or lost during the moving from a place to other. Unfortunately what you can and should do now is get all the documents they want ready and send them as soon as possible. The sooner you send them, the sooner they'll get back to reviewing your case.

You can write a letter explaining your living arrangements and why your name is not listed. The affidavits can be from anyone that know you both as a couple. Go to the examples section here on vj and there will one there you can adapt and use. Get any kind of document that can link you both to the same address, if you have financial documents that show you're sharing financial responsibilities, send those too.

Don't panic or let the disappointment hinder you. You got this! Good luck.

Unfortunately what you can and should do now is get all the documents they want ready and send them as soon as possible. The sooner you send them, the sooner they'll get back to reviewing your case.

I can do the medical next week, however I can only send the remainder s quickly as my license takes to arrive because I can't open a bank acc without it. I only went to get my license on Tuesday this week so they told me it'll probably come in 2 weeks however it can take up to 60 days!! All because I applied with my work permit so they have to verify my legal status and issue it with the same expiry as my license so it might be a good 2-3 weeks until I am able to submit the paperwork :(

p-ana, I think I'll write a letter anyway as you mentioned, even if I send the joint bank acc info once I get it because it'll be a brand new account so there won't really be a lot of financial movement in it. I'm also planning on getting a car which my husband will probably have to co-sign because I don't have credit here in the US but that isn't going to be for at least another 2 months or so.

This is the request for a 'copy' of the birth certificate, nowhere did it say original. Further up it says unless specified always send copies not originals:

2. Birth certificate

Submit a copy of your foreign birth certificate or other record of your birth that meets the provisions of secondary evidence found in Title 8, Code of Federal Regulations (CFR), 103.2(b)(2).

This is regarding what to submit from the medical examination (I submitted what was asked on the below):

  1. Fiancé(e)s: If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement, not the entire medical report. You may include the vaccination supplement with your Form I-485.

And nowhere did it ask to provide proof of marriage bona fides. I thought that's what the interview was for? To give you time to do things like get joint bank accounts etc seen as you need to wait for a status AND have a ssn....

Also status is still at 'fingerprint received on 17th March' and this letter came from California, I was not notified that my application had been transferred.

I'm confused too. Since when do AOS filers have to submit any sort of proof that the relationship or marriage is "legit". I agree, that's what the interview is for.

It's almost like they sent the RFE to the wrong person. A call might be a good start.

I don't know why they're asking for your original birth certificate, as it is not needed according to the instructions. Did you send a copy of the certificate AND a copy of the translation?

The medical examination is a little more tricky, I've been seeing a lot of people from London getting rfe because there's a "completed" box for the vaccines the doctors there don't tick (and are right not do do it) and the adjudicator wants it ticked. Did you send your a copy of your ds3025? Do you want to post the exact wording of your rfe so we can try and check around if there's anyone else in this same situation and what they did?

The good news for you, from what I can gather, they asking all of this and transferring you most likely means you're not going to have an interview and they want to have everything on file so they can just approve your case.

I'm confused too. Since when do AOS filers have to submit any sort of proof that the relationship or marriage is "legit". I agree, that's what the interview is for.

It's almost like they sent the RFE to the wrong person. A call might be a good start.

I think they want some sort of proof because they want to skip the interview and approve her.
