Hello,

I am a Canadian citizen trying to gather information about immigrating to the U.S. to marry my long-time fiance. My understanding is that I apply for the K1 visa, wait in Canada for 5+ months, go to the U.S., get married, wait in the U.S. for 5+ months, then I obtain a greencard (conditional permanent residency).

Is all of this correct? If so, what I am wondering about is how to I get health insurance during the 5+ months I am in the U.S.?

I took out travel insurance to cover myself and my daughter from the time we arrived until the time we were able to be included in my husbands health insurance.

Travel insurance is NOT valid for k1 purposes.

Maybe it depends on the country cause I had no problem with my travel insurance company insuring myself and my daughter for up to one year, I explained we were travelling as a k1 and K2 and he said that it was no issue.

Hello,

This will all largely depend on circumstances, so i'll give a brief overview of options:

As you know all those residing in the US must obtain health insurance or if not, pay a tax penalty.

1) if the US citizen is working and has health insurance via their employer they can add their foreign spouse upon marriage to their work plan.

2) if the US citizen has health insurance purchased out of pocket they can also do the same for their foreign spouse, either as an individual plan or obtain a joint spousal plan.

3) after marriage apply for adjustment of status for the foreign spouse and wait until obtaining the NOA1, this status would then make the spouse eligible to be enrolled into the federal health exchange (see the link in my signature for more info). whether or not you can obtain reduced rates through the subsidy all depends on a variety of factors, but for most you'll pretty much find the price on the exchange much the same high price as what you could by privately.

4) refer to rules of your state exchange if there is one for the state you'll be moving too and see if health insurance can be purchased for the foreign spouse there.

Footnote: as always, travel insurances or temporary short term insurances (especially those marketed towards immigrants into the US) are NOT federally compliant, and this means the tax penalty will still apply.

I bought an insurance for visitors at ***removed***.com until I got married and was able to be added on to my husband's insurance. Most travel insurances won't allow you to use it as you're not travelling, you're moving out of the country

The timeline could be faster or longer depending on processing. When you arrived and after you are married you can apply for AOS include your EAD (work permit) and AP (travel document) if workings and traveling is important to you while waiting for your greencard.

I enrolled in health care as soon as I arrived. I researched different options and picked one.
