Hi all,

This is my first post. I hope someone can help me! My husband has dual citizenship- he's a American and also a malaysian. We got married in Malaysia last year by using his malaysian identity card. He is submitting CR1 for me soon. Here's the questions:

1) there's no proof of his relationship with me as long as he has not submitted petition. Can I apply a tourist visa to visit him in USA?

2) anyone with the same background could share your experience with me? How long is the process take?

3) I applied tourist visa to visit him two years ago but rejected by US embassy in Malaysia. Because I told them honestly that I'm visiting my boyfriend. So they told me they suspect me won't be coming back Malaysia as - I'm single, I'm going alone & I have an American bf in US.

4) should we apply other visa to expedite the process?

Many thanks!

I do not understand how he could be a dual citizen as the Malaysian government is not approved of dual citizenship. However, I think that is irrelevant in your case.

As your husband used his Malaysian ID card, I doubt that the US government would recognize the marriage. For more information, you should visit the website below.

https://travel.state.gov/content/passports/en/abroad/events-and-records/marriage.html

And also, whatever you have said during your interview for your visitor visa to the US was recorded (or remembered in one way or the other). My advise is to NEVER lie as it will come back and "haunt" you eventually. I had to go through the interview twice as I did not provide enough information the first time. They required a letter from my company's HR stating that I will be back for my job. You have to give them enough reasons that you would be back to KL (I hope that was your intention in the first place).

Good luck!

1) I'm sure there is plenty of evidence you just have to look for it.

Huge list at the bottom of what can be used as evidence (not proof... proof is the marriage certificate) of a marital relationship.

2) Take some time and read the forum

3) Chances of getting a visitor visa as a spouse of a US citizen is very slim.

4) nothing can expedite your process unless it falls under the USCIS expedite rules. Check them out on USCIS.gov
