you need an attorney. This is a DIY site and you case is not DIY

I already have an attorney but I have a very bad experience with attorneys so I want to be able to understand what she is doing and the right way instead of seating and waiting for her to make my case worse.

My understanding is that courts are heavily backlogged and it could be years before you get a hearing, and politicians can not influence the courts.

Apparently you didn't not read my post it's not about a hearing buy a reopen and termination proceedings based on a approved i130.

So I guess their system failed to do so and now I am in a mess. During the interview the IOWA even said it's a mistake on their end but will have to go through procedures

USCIS publishes many casefiles online, about BIA hearings, casefile documents submitted by humans. Maybe it's time to search there, until you find a casefile that mimics your need, then edit it a bit to reflect your exact situation?

Hello everyone an update on the removal proceedings case.

After filing a motion to reopen the removal proceedings the chief council agreed then my lawyer filed a joint motion to terminate which was also granted.

Now my question is how long is going to take uscis to give the GC since I had already done the interview with my medical still up to date? Does anyone here experience this situation? Are they going to go back on the normal procession time which for atlanta is 5 months? Or will they consider the fact that the interview is already done with the i130 approved?

Also during the infopass the officer said the i485 is administratively closed and as soon as the Judge terminate the removal proceedings they were going to reopen is that true or I will still have to reapply for the form i485?

Please anyone???

Right after IJ close your removal proceeding USCIS will automatically re-open your I-485 and will notify you about that. If they need additional documents they will send you RFE, if not they will schedule you with interview date. YES you will have another interview!

Every case is different but for example IJ closed my removal proceedings in Jan 2015, and I got interview notice for April 19, 2015. So it will take a few months!

I really hope I don't go for another interview I got no RFE till now and my medical is still up to date so I am praying?

Once my I-130 was approved (which was in June) my lawyer immediately requested master hearing with IJ to cancel my removal proceedings. Appearance date was January next year. So it took 6 months. After removal was canceled (in January) USCIS scheduled interview for April. We were approved on the spot.

3 days later we received WELCOME TO THE UNITED STATES letter from USCIS.

I have a well documented thread about this. It happened to us January 2015, we just filed AOS last month. If you go to my profile and search content it will show up as "a visit from ICE..." Or search that in the forum search, all our stuff is in it because it's too much to reply here! We However did not have to reopen, just termination.

**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

(STAND ALONE i-130/TERMINATION OF REMOVAL)

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

NOA1: Feb. 20, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

(AOS AFTER TERMINATION)

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

Infopass #1 at local office: Dec. 19, 2016- Case pending background/security checks, advised when to renew EAD #2
