ITIN for State Taxes?

Hi folks.

I am applying for an ITIN for my wife with my federal tax return.

What do I put on my state tax returns? Do I need an ITIN for that as well? How does it work?

12/13 - Approved!

There could be 50 different answers but I would just use the Federal number

She doesn't have an ITIN yet. From what I understood, we had to file for it WITH the federal tax return. Is that something that you get back immediately, and then have to put on the state forms? Or is there another way? Cuz I don't know if I'll get that back in time now... :(

Some states allow you to use "APPLIED FOR" but I would check your individual state instructions/website for guidance since we dont know what state you are in

fwaguy is right, there will be 50 answers to this question.

I just filed my federal return as married filing jointly and requested an ITIN number. And yes you do send your return to a special address (Austin TX) with the W7 and required proof.

For my New York State taxes, from what I can tell, I just write NRA (Non-Resident Alien) for my wifes SS number. If you leave it blank, they'll return it right back to you as it is incomplete.

My accountant told me to wait a little while before sending the State taxes just in case something funny happens with the federal. So I'll probably wait till beginning of April.

It's confusing! All I can tell you from my experience is to contact the state. In my case I filed the W7 and 1040 Federal (Married filing jointly). For state I filed Married filing separately (per my inexperienced HR Block tax advisor). In retrospect I should have filed jointly.

In my state (NJ), I was told that I should "generally" file the same status in State and Federal (Married Filing Jointly) BUT there are cases where you can file differently. Since my alien spouse does not / has not lived in NJ during the entire 2006 tax year AND she has not earned any NJ related income then I decided to file separately. In retrospect, I should have filed jointly. I blame myself for listening to my HR block guy whom I will never go to again. Come to think of it, I probably would have received a greater return since her income would not be taxable. I wrote to my State treasurer and am awaiting a response. It's kinda moot since I already mailed the forms out.

Contact your state treasurer and ask what you should do. I emailed mine back after the fact but I figure if it's something critical, I can amend it. Since you don't have an ITIN for state (I didn't have one either) you might be able to put applied for ITIN or something. If she has never lived or earned money in your state, you might be able to do the same as me and do Married Filing separately.

Here is the answer for NJ, in case anyone else needs it. Thanks for pointing me in the right direction!

The New Jersey Gross Income Tax Act requires a taxpayer to include a social security number or ITIN (Individual Taxpayer Identification Number) on the gross income tax return for identification purposes. The taxpayer should use the same identification number on the New Jersey gross income tax return that is used for federal income tax purposes. If you will know your identification number by April 15, you should file your income tax return the same way as you are filing for federal income tax purposes. Taxpayers who have applied to the IRS, but have not received a Taxpayer Identification Number by April 15, may file the New Jersey income tax return and attach a copy of Federal Form W-7 (Application for IRS Individual Taxpayer Identification Number) by the due date of the return. Otherwise, the taxpayer should consider filing an extension of time to file an income tax return.

That is what makes life in these here United States so interesting... anytime you are dealing with a state sponsored activity you have 50 different ways to do it.... so no one answer is the same.....

You should have been told to attach a copy of the W-7 & Certification to the back of your State Tax Form.

(But, if you did it yourself (without help) then I will tell you that that is what I was told by an IRS Agent who handles W-7's). In the space where it asks for your spouses SSN you should put ITIN Applied for on State and Federal returns.

I am mailing a copy of the w-7 and Kathlene's passport info with my KY state taxes. I think that will work as well.

(I hope so, I plan to use my tax refund to pay the expenses of her trip to Manila for her interview! :P )
