Hi VJ members,

I need help for filing taxes, here is my story:

I came to U.S. as a F1-student in 2014, and always lived in U.S. I married to my partner(who is a U.S. citizen) in Dec. 2015, and I have income both on campus and off campus during 2015. My I-20 expired on Feb. 1st, 2015, which means I'm no longer a F1 now. And I'm waiting for my interview for the green card in March. I haven't got my EAD card yet.

So my biggest question is that should I file my taxes jointly with my partner? Or if we file separately, am I still able to file taxes as a F1 student after I just graduated this Feb.?

Also, technically, I have no status now except I have a pending for green card. I did research online before I can stay in U.S. while waiting for my green card. But the tricky part or confused part is that how should i file my taxes now when I have no legal status?

Thanks! (L)
