I just received the letter stating that my I-751 was denied due to missed interview :(

Here is my story, but pls don't judge me, I'm aware it is my fault. I'm seeking for help, not judgement.

My husband just got a new job and he has to be out of town for a month and a half for training. I missed him so I drove 4 hours to come see him and stay there with him, so basically we weren't home to pick up our mail at the mailbox, so it got accumulated. The mailman took all my mails and sent them back to the senders ( not his fault, my fault I know, I should have given them notice to hold my mail), that is why I never got the interview letter from USCIS :(. So today I got the denied letter because we didn't appear at the interview. I'm so stressed right now, what can I do now? I need your advice, thanks in advance!

Did you ever check your case status on-line? Normally they update status once mail is non-delivered.

You should schedule an infopass ASAP to explain matter in person at local USCIS. If you are lucky, you would be able to meet your case handler. Good luck.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You should schedule an infopass ASAP to explain matter in person at local USCIS. If you are lucky, you would be able to meet your case handler. Good luck.

Yes, I did it often. I even call USCIS 1800 number to ask about my case, but there was never a new update. i'm trying to make an Infopass appt but their website said there is none available. I will keep trying.

Also, I talked to an immigration consultant and he suggest to file either I-290B to reconsider the decision or re file another I 751. I'm not sure which one is better for my case.

You could try a walk in- ie show up at the USCIS office with all your papers and hope they let you in.

Stupid thing is why can't they just show these types of status updates online? They don't show RFEs, they don't show interview notices. All it shows is either "processing" or "approved". yesterday, someone else shared their denial letter based on not responding to RFE on time and they said they never received the RFE letter in the mail. RFE won't show online so so they knew.

Mails get lost, people travel, etc etc. it's year 2016 USCIS, show every little status update online too, like case assigned to agent, waiting for background checks, RFE sent, interview notice sent, etc.

Traditional mail if the official way of communication for all government agencies because they can actually be tracked and proof of delivery can be obtained. They don't have show that because 1. it is either not covered due to limited funding for such customization,

2. not everyone has internet access so they can't use the internet as the means of notifying applicants about their case.

OP understands it's her fault. It is not USCIS fault.

USCIS needs to make improvements for the benefit of all of us. We know for a fact that they have an internal tracking system. How do we know that? Because when you talk to a Tier 2 agent, they can see exactly where you case stands. All they need to do is to make the current status visible to the applicant. They should still keep the paper-based communication as the primary way but allow people track their cases in detail online as well. Sorry but in 2016 I do not accept not everyone has internet access as an excuse for not implementing such a service. If they want funding, just increase filing fees by 1$, that would generate 6 million$ a year, which should easily cover the cost of such an upgrade.

It would even suffice if they just say a mail is on it's way without showing the content. How about something like "On February 26 2016, we sent you a mail with tracking number xxxx. please contact us if you do not receive the mail by March yyy" ? That's it. No need to mention if it is RFE, interview notice, approval notice, or the new card itself but just let the applicant know something is on the way.

Like i said before, those customization seem simple to us but it takes funds to be able to add that on top the current functionalities. Limited funding and bureaucracies makes it an uphill battle to make simple changes. I work in a govt agency and I know this for a fact. USCIS do not have to give you a tracking number. The tracking is for their own use. To make sure what needs to be mailed is mailed and when it was sent out.

It seems like you expect too much from a government agency.It is 2016 but lots of agencies are still working with archaic software which have been functional and efficient for their organization workflow. It takes decades for changes to happen , if they do. Your representatives decided how much to give them so be mad at them. And by the way, $1 or even $10 fee increase can't do much.

I agree with you 101%...This is 2016 not the stone age. Everyone has internet if not in your house our cellphone. Text messages and free public wifi at Starbucks. Get with the program USCIS.

Re-file ASAP (before being placed into terminal proceedings).

You were properly denied.

That is correct. just have to file and spend the money again.i am not sure if you can ask for a fee waiver if you can convince that it was a genuine mistake.please do so fast before your 1 year extension expires.

I am trying to explain to you how things work in government agencies. Don't come after me or the agency. They don't themselves.

The fees alone cannot support the operations of USCIS. Go read about public funding and educate yourself.

There are up times and downs.. Applications are not overflowing at all times. Their system has to function during the "down times" also. So USCIS will need federal funds in addition to the fees charged to be able to run effectively. SO that $1 fee increase alone cannot sustain the employment of software developers (put them on retirement system, with all benefits).

Your application goes through different groups for processing and they are get full benefits and should be paid whether more application come in or not. So yea, the fee is may seem as "enormous" but your fee alone does not cover the cost of process your application to the government.

USCIS cannot base their fundings on "denials". People spent time to work on application to Decision stage in other to be denied. So not the same outcomes but same amount of work.

it is stoneage in government agencies so get comfortable.

YIKES how long were you gone for? I've gone a while without checking my mail (habitually-- long story about my old apartment building and where the mailroom was and how forgetful I am and how most of it is junk mail anyway) and it was ALWAYS collected at the main hub post office for my area, with a little slip left in the mailbox telling me where to pick my my giant pile of mail (almost all junk). Maybe there was something in there about how if I didn't come within a certain number of days, they'd return to sender but at that point it would have been months....

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Thank you for the responses! So can I re-file I-751 since in the denial notice says my status is terminated. It says I can file I-290B to reopen or reconsider the case. I made an infopass appt at my local Uscis but it is 10 days from now which is the earliest I can get. I called the uscis 1800 number to speak to a representative and she suggested me to do what the denial letter told me to, she even said the IO at my local Uscis probably just say that the same thing. I already filled in form I 290B motion to reopen form but have not sent yet.Should I wait after the infopass appt to see if there is something else I can do? Sorry everybody I'm so upset and confused now, I appreciate all your help !
