It took me 5 months to get the document back - then the application was not approved as well.

The next time I did it properly - went to an IRS "Authorized Agent" for W-7s and the passport was xeroxed and handed back to my wife.

Ok, I paper (don't think there's another way) file my taxes and mailed them using USPS on February 7th 2007.

Today, March 12, 2007, I got my wife's ITIN number on a US Dept. of Treasury document.

I also sent in the original passport with the W7 and federal tax return, but did not get it back. I imagine I'll get her passport back after my federal taxes are done (probably 3-4 more weeks).

Also, I believe I checked the box "Spouse of US citizen". I know that part of the W7 can be confusing.

according to the instructions for the W7, "Original documents you submit will be returned to you. You do not

need to provide a return envelope. If your original documents are not

returned within 60 days, you can call the IRS at 1-800-829-1040" so try calling again and see what they say.

It's ok to send a notarized copy if it is done in another country - the "Hague Convention" rules apply - except in the Philippines where Philippine Attourneys have now been DISQUALIFIED to notarize documents sent to the U.S. Government. There is one Agent in the P.I. IRS Acceptance Agent - otherwise an Embassy Officer.

My wife got a certified copy from the passport office in Cagayan de Oro and sent it to me. I just received her ITIN number last week, so they accepted the copy just fine. I figured if they did not accept it, I would just file an extension and wait until she gets here since we are getting a refund and would not owe anything to pay penalties on.
