I've just received notice that my husband's application for employment (EAD) permission has been approved. He is adjusting status from a K1 visa, and we filed the I-765 (EAD) along with the I-131 (advanced parole) and the I-485 adjustment of status (AOS). It's great that the EAD is approved, but we are a little terrified because we received a NOA on the I-765 and the I-485 but NOTHING on the I-131.

We know that I-131 and I-765 procession are now often done together, so we thought that perhaps the I-131 just doesn't show up separately now on the USCIS site/NOA forms, but now that the approval also mentions only the EAD, we are afraid he will receive that WITHOUT permission to travel. He urgently needs to travel, and ordinarily, it would be no problem for him to receive the I-131 AP when adjusting from K1 status.

Could someone please advise? All materials were sent together, so it is not clear to us how the I-131 application could have been lost/separated from the others. If we need to follow-up on it, how do we check on it? The NOA for the I-485 and I-765 were confirmed on December 9.

If you filed the I765 and I131 together, you should be receiving a combo card in the mail. If you do receive only the EAD authorization card, then I think you can assume that the I131 petition wasn't received.

If urgent travel is needed, he can schedule an infoPass appointment and bring proof of emergency travel. They will approve travel authorization the same day, although you will need to pay more fees relating to this.

Do you (or anyone else) know if it is possible that the I-131 is received & processed, but not listed??? or should we assume that since it is not on the USCIS status check page for him, that it just somehow was separated and lost from the rest of the package?

I don't think he would qualify for traditional urgent need to travel criteria, unfortunately. The threshold is different for K1's, so we were looking forward to his processing through that route for travel.

I've seen people who have arrived on K1 and successfully obtained emergency travel authorization but, mostly because the dire situation warranted it.

It could be possible that they failed to list it on the case status. You can always call USCIS at their 800 number to find out the status and what type of card will he be receiving.

I would call USCIS to find out more information regarding your I-131.

Now, if they cannot give you more information on time, I would schedule an infopass and bring proof of why he needs to travel outside the country urgently. They should approve travel the same day.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
