My fiancee K-1 visa revoked

I met her for the first time in person April 2015 in U.A.E. and I met her and her family in December 2015 in Philippines. We are planing on getting married in December in the Philippines. The letter she got is a 221(g) and at bottom there is a check mark by other and the officer wrote in there (Petition to be revoked to NVC )

You need to be clear when posting in order to get the correct advice.

You said the visa was revoked in you first post. Now you seem to say that no visa was issued and she received a 221g and that the petition

will be returned to USCIS (via NVC where it will be briefly routed from to USCIS) with recommendation to revoke the petition. Is my guess correct ?

You have 2 options :

A. file another K1

B. marry in the PI and file a CR1

Your petition will be returned and it will be purposely expired and you will receive a letter in about 6 months saying the petition is expired

and you can file another petition.

I am sorry that your fiance was not approved but there is nothing you can do to tun it around except to start over with another petition.

Since the CO suggested getting married I would do so rather than doing another K1.

the visa was not revoked, it was never issued. You need to get your facts straight before asking for advice. At her interview she was denied the visa and the PETITION is being sent back to USCIS to be revoked because the CO didn't believe you had a bonafide relationship and she was using you to get to the US.

Marrying her will not get you a visa. You must address the issues for the denial, fix them and then proceed from there.

What is a waiver? And what is misrepresentation mean? We have good evidence with phone and Gmail records 2013,2014,2015 and me meeting her in person in 2015. We are lacking Facebook n Skype from 2013, 2014. Will the embassy tell us why she was denied ever? Can a immigration lawyer find out why we got denied?

To set this correct I tried putting the letter on here and it didn't work so if I have misinformed anyone sorry. Just remember know one in life is perfect. I am only looking for some kind of information to help me understand our situation? And trying to figure out what we did wrong and how to fix it?

Talk to your fiance in excruciating detail of what happened at the consulate. You may have to have up to ten conversations about it to get a complete picture. Only your fiance can tell you what happened. Also remember when she is telling you that she may not be processing and relaying the VO tone and body language correctly. No one on here can tell you what happened at your interview. Have your fiance step through each question and each reaction in detail. Did a picture cause the VO to pause. Hope that helps.

If you file another K1 you need a multiple filing waiver. If you marry and do a CR1 you won't need it.

People here brought up misrepresentation because it could have been the reason for refusal but it is not marked on the 221g paper.

The CO did not believe you have a bona fide relationship as you posted this : My fiance said the consular looked at her and said in his eyes and what he believes is she is only going to US to migrate and not marry me. They can reach that conclusion with their discretionary authorities and while they

should have a factual reason, they often do not.

The CO suggested you marry and he would be more convinced to approve. So do it, marry and file a CR1.

You should have more real time together, make more visits, anything that makes your relationship genuine you can submit and front load

on the next petition. No big deal that you lack FB for 2013 and 2014 but you can go into your FB settings and print the messages if you messaged

each other then.You can't submit what you don't have. Visit ! Be on the premises for the next interview !

I stated the reason for refusal above, CO doesn't believe in a genuine relationship, you probably didn't include enough evidence and

didn't front load and did not visit enough.

It's not about being perfect.

I have given you the information you need.

Sometimes you do nothing 'wrong' but just didn't convince the CO and they can refuse to issue the visa if they feel it is not a genuine or lasting

relationship.

The blanket statement "for immigration benefits only" is often written into the 221g paper without further specific reasons.

You can't fix it, you can only file a new petition.

Some do, some do not. It is not necessary if you can follow all the steps in the guides.

Save the money and get another visit in instead for relationship evidence.

I had a lawyer and fired him because he was useless though handpicked out of a referral list of 40.

Can someone lead me in the right direction I am trying to find out what I need to get a visa for the Philippines. So I can stay up too 2 months or longer.And how much would it cost and what paperwork do I need for visa?
