Can someone tell me what this letter means from the embassy.He has it marked by passport and marked by other saying revoked.This is the only letter she got from the consular officer. My fiance said the consular looked at her and said in his eyes and what he believes is she is only going to US to migrate and not marry me. How can a consular officer assume another person's actions? I am just trying to figure this out.

I am sorry your fiance got denied; but that is the consular officers job, to try and figure out who truly wants to get married for bonafide reasons, and who is just getting married for immigration benefits. Otherwise, visas would not be needed. Of course, they get it wrong on occasion.

You can try again, usually couples do that by withdrawing the K1 and getting married. But first, you need to figure out exactly why you were denied and work to resolve that issue.

Is there any red flags in your case, such as large age or religious differences? Prior immigration attempts or you having a previous foreign spouse? Recent divorce? How often and for how long have you met?

Hi my fiance was denied the k1 in September. I refiled a second K1 in October. Only your fiance knows all that happened that day. So I would never advise anyone to just rush and marry cause if you are continually denied, you are still married. So calm down a bit, comfort each other then have your fiance go over in excruciating detail what happened at the interview and what was on his/ her ds160 and previous visa refusals applications. A k1 is pretty much guaranteed unless the VO finds something that USCIS, if they had seen, would not have approved the petition. I am sorry for you. I know the feeling

I am sorry you both were denied. You should look at the paper they gave your fiancé and see what code it says. There is nothing to do at this point but wait for the petition to die out (1 year) or as another stated withdraw it and refile.

When you refile make sure you send the waiver request with it. I forgot this step so I am waiting for an RFE.

I was denied as well because I was not present, that was basically the sole reason for my denial according to my fiancé. Next time around just be present for the interview. If there was anything missing or any type of red flags you think they saw - address them now before you refile.

Otherwise you will get denied again. Getting married it up to you. They can still deny you when you are married if they feel there are RED FLAGS. I've recently red 2 stories on here in the past couple months of two people being denied that were married. Not sure of the REAL reason but they posted on here they were denied.

So look over all your evidence and anything you deem has flaws, holes, or could raise a question.. write a statement to go with it.

A k1 dies after 4 months. It is probably already dead. so he/ she really has no wait time involved at this point. I received my notice of decision on the first on Dec 7 that it expired and I was free to refile. A lot depends on what the fiance was told at the interview and what the refusal letter states

The OP seems to indicate that the visa was issued but was then revoked. This is rare, but it happens. The CO or his Section Chief probably found additional information (or reviewed existing facts) and changed the decision.

If the reason for revocation is misrepresentation, that quashes the prospects of any U.S. visa, ever. If the code is 214b, that might leave some (dim) future hope, depending on the reason stated.

I know just enough to be dangerous. I defer to the member HFM181818, a retired CO who can comment with full believability. I think that he's away from VJ for a couple of days, so be patient. Meanwhile, search his posts, read them, and absorb them -- any one of them can be a complete education in itself.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

Please clarify what you mean by 'revoked'. Can you post the letter with the personal items removed ?

Only USCIS can revoke a petition but the CO can refuse to issue the visa and return the petition to USCIS with recommendation to revoke.

Are you saying the visa was issued and later the CO changed his mind or what ? Please clarify.

I heard of the case of K1 visa revocation. They stamped the visa. Then 3 days later asked to come back since they forgot something. Took the passport and stamped revoked. Turned out months later that beneficiaries ex-wife also applied for K1 at the same time (which was purely coincidence).

The consular officer I asked her why she picked me out of all those people on that dating site AYI (are you interested) and he also wanted to know why we didn't get married in the Philippines in December when I was there. All we had left was the embassy interview. He told her we should marry outside of USA or in her home country the Philippines and then he might approve her visa then? I am 45 she is 34 and my religion is Lutheran and her's is Catholic. I am going switch to Catholic. We met September 7, 2013 on AYI and then we talked on cell and yahoo,Gmail,Facebook,, and Skype. He didn't even look at our phone records, He looked a little at Gmail. We don't have any 2013-14 Facebook or Skype my computer has crashed and lost passwords. But we do have but she forgot to bring to embassy was our 1st messages on yahoo. I will try get picture on here without case# and name

since she's an OFW from the PI in UAE, perhaps there was something interesting or strange during the background check and wasn't completely reviewed prior to the actual interview. After interview, another review is always done.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

I met her for the first time in person April 2015 in U.A.E. and I met her and her family in December 2015 in Philippines. We are planing on getting married in December in the Philippines. The letter she got is a 221(g) and at bottom there is a check mark by other and the officer wrote in there (Petition to be revoked to NVC )

A revoked visa due to misrepresentation does not quash the prospects of a visa to the USA. It only means that the applicant/qualifying relative has to do a waiver for immigrant visa. It also doesn't even squash the prospect of a B1/B2 in extenuating circumstances like a relative funeral or something. You'd be surprised the waivers that get thru. I have spent the past few months reading all the appeals. people entering without inspection (ie. waved thru without being presumed to be an American citizen), assault offenses. As long as they have a good write up and the law to fall back on, it is very doable. The only people who apparently can't get waivers are alien smugglers, presumed terrorist, and people claiming to be US citizens.

As we in engineering like to say, the answer is always "it depends"
