First year filing taxes together permanent resident HELP!

Hi all. This is our first year filing taxes with my husband being a legal permanent resident. Question, my husband received two W2's, the first one with his former employer that he used a made up social security number and one from his new employer where he used his new valid social security number. In the past, we have filed our taxes together and I have just used his TIN number not the made up SS# and we have never had issues.

My question is, is there a way or a process to have his former employer reissue his W2 with his new valid SS# or can we just file our taxes with his new valid number and claim the income from the W2 with the made up SS#?

I have called some tax places and they have been very racist and indignant with me saying he needs to have his former employer change his SS# and reissue the corrected W2, but we don't want to have to do this if it is not necessary. And if we do, we don't want them to report him for using a made up SS# on his W4....

Thanks!

Filing your taxes with a "made up" social security number would be a problem. It could lead to the person with the ficticious SSN being asked to leave the country.

Choose your path wisely.

What's racist about telling him to fix the issue? It's the responsible thing to do, that is someone elses social security.....don't see how race is involved in that. You called reputable tax places, got the advice, didn't like it so they're racists and indignant? What he did was wrong and he needs to fix it, just the way it is....you don't have to like it.

you wil need to contact the former employer giving them a true copy of correct SS # and ask he send corrected W 2

Since he paid in under the fake # and did not see a true SS card both of you are responsible for what happens next

he will be upset as he paid the benefits under a fake # like your withholding taxes, unemployment insurance and medicare

He can report you for the fake # but i doubt he will as he should have taken a legal copy of SS card when he employed you

but he will not be happy with you

I imagine his former employer wouldn't want to get involved now, since they could potentially get into trouble for hiring someone that wasn't legally eligible to work.

If it was me, I would just let it be and move on because you are just going to invite trouble down the road. Just be glad he got legal status and move forward with your life together.

Wow, I didn't expect this from this forum... Yes my husband used a made up social, but the last time I checked many illegal immigrants do this to work and as long as they only use it for work they are not prosecuted. My husband only used it for work, never for anything else and he always filed taxes and paid.

Second, the reason I said two of the places I called were racist was because they went on and on about how they hate what my husband did and they wished the illegals would go away and that's the problem in this country now, and on and on. If anyone knows about what we are going through, it is the people on this forum. Maybe many will say my husband coming here illegally was wrong, but they don't know his whole story or what we also just went through to get him legal. The time, money, fear and anxiety.

No one has answered my question though, there is not a lot of help or advise for people in our situation that received waivers. We have a unique set of challenges going from him being here illegally and now being legal. We want to do the right thing and I don't always trust what tax places say as a lot of them don't know what they are doing and again our situation is not common.

I was hoping someone on here perhaps had a situation similar to ours and could maybe give some advise.

I wish you all the best of luck in your journeys.

Illegal isn't a race. It isn't racist even if you don't like it.

People who are against a group of people because of their race and status in this Country are racists. But if you don't agree that is fine. It really isn't even the point of my question. But thanks for your input.

I highly suggest not filing with the made up social. Not only could it cause you issued, but the person who could rightfully have the social may not receive their tax refund. Incredibly irresponsible. he needs to use his rightful number

Now that he has an SSN, he must use that SSN to file taxes. He cannot use his ITIN anymore.

Yes, that is correct. I canceled his ITIN with the IRS already and also provided them with his social security number.

I really don't think I am going to get my question answered. But I appreciate everyone. Thanks

Right, he has never filed with a fake social security number. He only used that number to get the job and the place he worked employs many illegals, they don't E Verify.... He always filed his taxes with his ITIN number.

I don't think everyone is understanding my question at all...

He never filed taxes with a fake number. Yes, he is going to use his new valid social to file taxes. My question is that he has a W2 from his previous employer with the fake social on it. I need to know if we should have this corrected with his valid social number or just file our taxes and not do anything else.

I agree with you but I doubt they knew his race or country, only that he was illegal. I hate people who are here illegally or use fake SSNs no matter what country they're from, doesn't make me the least bit racist.
