Timeline

Okay, with that RFE I am not sure - maybe someone else has an idea! To me it sounds like they have no record of your medical, but this might just be crappy unclear USCIS language?

Well yes thats my worry. How do I know if I need a full new medical?

I dont want to mess this up. Its unlear whether its a full new medical or just a signed off i693 that I had the vaccinations done... Can anyone shed some light? Anyone seen this RFE before?

Can you elaborate on the RFE?

Does it say an address to send it to and a deadline for how many days you have?

Or does it say, IF you did not send an I-693 then blah blah blah

It is possible they did not find your medical file from POE and they are requesting a full medical. Yes they lose them. It 's possible it's a generic reminder because not everybody includes medical or vaccs with original application. You did via POE.

I wouldn't rush off to a doctor tomorrow not really understanding what you need or if you need it. That's why I am asking if your RFE is actually an RFE. Write it all out if there is more.

Just to add, the bit about 84 days is at the bottom. Some paragraph about 84 days but the DATE in the middle in big is April 20

Your EAD can be approved an issued even if you have an RFE on the Green card. I wouldn't worry about it not coming in a week or so.

As to the RFE. It's a real RFE. And it says they need a medical report and vaccination record.

Some choices in my opinion--

OPTION 1) Respond to the RFE with a written statement/letter saying you are adjusting status as a K1 visa entrant and USCIS policy manual states in Volume 8 Admissibility, Part B Health-Related Grounds of Inadmissibility

Chapter 3 Applicability of Medical Examination and Vaccination Requirement:

B. Special Considerations Nonimmigrants Applying for Adjustment​

​4. K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:​

The medical examination did not reveal a Class A medical condition; or ​

The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions.​

If a new medical examination is required and reveals a Class ​A​ medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application.​

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician. ​

An applicants overseas medical examination report completed by a panel physician should already be in the applicants A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).​

Tell them the date of your medical examination by a panel physician and that one year has not passed. And that your vaccination record was complete and the original form is part of you medical file. Ask them to verify that they have ordered your A-file which contains your valid medical examination and proof of all required vaccinations or that USCIS has lost your medical file. And put that last part in big bold letters so they see it.

Do send back the RFE sheet with it so it gets routed to the proper person. (Make a photocopy to keep).

OPTION 2) Pay for a new full medical exam including all the blood work and TB skin test and vaccination assessment and send it with the RFE page.

If they lost your medical exam, then you have to do another. If that's the case, then getting a new immunization form done tomorrow doesn't solve the RFE. If they simply made a mistake and didn't get your medical from your A-file, then the letter will remind them you are a K1 and are not supposed to do another.

Nich Nick - Im going to go with option A to start. I dont want to have to spend the money if it can be avoided. Im going to write up a letter. So just so I understand, I will put in all my info, then paste in the text you have and give them details of my medical in London. Ask them to verify A-File in BOLD. Also are you saying not to send back the copy of the RFE? Just keep it for myself?

No, send in the RFE letter - but make a copy for your records. Also send a copy of your DS-3025 if you have it as proof for vaccinations.

No. there's nothing wrong with your A Number.

The crucial question bit is Please verify that you have requested my A-file to obtain my valid medical record and completed vaccination record. If you have lost my medical file, please inform me.

Just saw your previous question. Yes to sending RFE LETTER back with your response. But photocopy it before you mail it off so you have photocopy to keep. Never send your only copy of anything off in the mail in case you want to look at it again.
