Hi we are filing all of our paper work. Went to doctor in USA and sending in all this paper work in. Does anyone know how long the Status Adjustment period takes? My wife has a son is 20 years old. Online it says as long he is under 21 before the adjustment period is over we are ok.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

There is no set time frame for AOS processing. There are a couple of different processing paths that USCIS has with the AOS, approve, or deny. with, or without interview, or RFE, and, in addition, you case can be assigned to the NBC, or your local field office for processing. It is completed when it is done. Take a look at some of the numerous monthly filing threads in this AOS Progress Forum. Hopefully, the child will be adjudicated prior to reaching 21.

I can understand your concern about the son possibly aging out. We were concerned about the same thing with my wife's then 19yo son. That is one of the primary reasons we filed our AOS applications about 2 weeks after our marriage. We were fortunate to get quick AOS processing, but had a "screwball" AOS interview. But thankfully we were approved and did get our GCs.

I am sending in our I 485 for adjustment status for my wife and her son. How long do you think this should take? We are a little concerned we started this process when he was 19 after all the paper and embassy meeting etc he is now 20 and turns 21 in June. Thanks for any insights in the time frame.

I think there are some processing timelines on here. Maybe have a look at the for your state.

I am in Minnesota, I planned for 12 months and it ended up taking about 7 I believe. I got the letter for waiving the interview that was supposed to delay things for at least 6 months, but somehow got a green card a few weeks later!

Unfortunately, every case seems to be a little different, but hopefully the timelines help give you a ball park.

My plan is plan for the worst case scenario (long wait) and hope for the best!

07/27/2017: NOA1 Received

10/14/2017: Biometrics Waived

10/27/2018: ROC Approved

If you mail it today, they should receive it on February 29th. You will get your texts/emails (if sending e-notification form) withing 5-10 business days of that. You can expect a biometrics appointment within a week to a month after that.

You should be looking at the last week of May or first week of June to have your EAD/AP.

However, for your GC, there is no timeline - that's why you are having a problem finding information. You could be one of the ones that get their GC before the EAD/AP, you could be one that gets it right after, you could have an interview or you may not have an interview. It's like asking how long is a piece of sting? There is no answer to your question the way USCIS is processing I-485 petitions currently.

I looked online on the gov website. It says to send out I-485 to Chicago I am guessing that is right. I do read on this site people saying to check with their local office for certain things but sending it to Chicago is correct?

No. The AOS petitions are mailed to Chicago, but they are worked at the National Benefits Center (NBC), which is in Fort Lee, Missouri. If your case is selected for interview, then you may need to wait for the case to be transferred to your local office. However, your case could say it's "Ready for Interview", but then not get an interview at all. If your case is approved without an interview, then it's approved at the NBC/MSC. So it's hard to tell. If it's transferred, look to your local office time frames. If it's not, then there is still no way of knowing.

If it's any consolation, I think the GC's have been issued much faster than they were in 2014-early 2015. Some people were getting NPIW, and still waiting 6+ months, but now they seem to be waiting much less than that!

Also wondering what you put for the current uscis status on the I-485 form? since we got married she would no longer be a K1 on the status is that correct?

No. Marriage does not affect status. Her status would be K-1 if it's still within the I-94 period. If the I-94 period has already expired, she can put something like "K-1 (out of status)".
