I am filing I-130 for my husband who has a received a fine in his home country for having marijuana ingested. It was found in his system during a police intoxication blood test following a car accident (he was a passenger). This happened nearly 7 years ago now, and obviously he/we will not lie about his past. He has not tried any drugs since then.

The fine is supposedly no longer on his record, and he has never been charged with possession of marijuana or any other narcotics.

He never needed to see a judge, or partake in any court proceedings, it was a payable fine like a traffic ticket.

How is this likely to affect his case? Should we contact a lawyer?

If he has never been charged, how did he get the fine? Which country is this in?

If there is nothing on his record, considering how long ago it was, it is possible that he will get the visa right away even with admitting one time drug use 11 years ago. But it is also possible they will delay the visa for a time- 6 months or a year is common- and have him do random drug tests during that time.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Timeline

I came to this site because I've had the same situation before. I admitted to using Marijuana during the MEDICAL EXAM. They scheduled a drug test a couple of weeks after, I dont know if I turned POSITIVE but on my interview, the consul approved my IMMIGRANT VISA.

Right now I'm living in Las Vegas.
