He will be wasting his time and money.

His mother's immigration status has expired and she has no immigration benefit to extend to OP.

She has two applications in parallel.

1) Which her mother filed(F2B). Yes she cannot continue with this one

2) Which her brother filed(F4). She can continue with that.

Yes my brother called to nvc they told him that your case is approved but your approval letter is not delivered then my brother request to change current address and contact number they said you will get approval letter within 3,working days

That's good. Just to make sure ask your brother to call them again to confirm if you guys still have one year.

I still don't understand if they will reject my visa then why they are asking me DNA and domicile.. they simly reject me due to I haven't a ground now

That's good. Just to make sure ask your brother to call them again to confirm if you guys still have one year.

That I am not sure about. You should confirm this with embassy. I am just making an assumption.

Your mother can no longer file for you. She has no legal grounds to file for you. Her status has expired and she never became a citizen so she can't file for you. SO you will get denied.

Well that fine as you still have an option, and it's right there. You just need to go through NVC process which is just another 3-4 months, as the Priority Date for f4 is 01JUL03 your date is current. So no worries

Really panic situation still after waiting 11years .. they should not approved my mother petition

Your mother was supposed to withdraw the petition when she gave up residency. Something she likely did by default, and not via the official methods. You keep blaming the system when your family did not follow through on their obligations. Most likely because they had no idea they should have withdrawn the petition. But the system is doing what its supposed to do. With an active petition that was not withdrawn, which has now become current, they called you for an interview and are reviewing your eligibility for the visa.

it is not USCIS' fault that your mother did not withdraw the petition when she moved back to Pakistan. How on Earth were they supposed to know she moved 5 years ago unless they were told?????????? Stop blaming the system for something they had NO knowledge of!!!! SMH

They know that her mother moved back to Pakistan, that's why they ask her to explain when her mother has plans to move back to US and what's her intended address. And not everyone knows that they need to withdraw the application if the petitioner is not living in US anymore. So relax, she is here for help. So tell her what's best to do now rather than just criticizing about the things she wasn't sure about as she told everything they asked during the interview.

Yes your are saying 100% right.. If we know the condition never ever waste time and money... Today my brother put up his petition and assigned isl case #...Thanks to Allah we know on the time otherwise we lost other chance also...

can you tell me how can I withdraw my mother petition or before withdraw should I mail to embassy tell them about all condition ? they already know but may be they want to take written statement... My all original documents also submitted there, how can I get back?

Yeah you should send them an email about the current situation. And ask them if they are not continuing this application, send back you original documents.
