10 days in enough, your brother should call NVC and tell them he want's to continue with his petition and that will buy you one more year. Then you can continue with that.

ok They will extend 1 year more only on call? My brother call them today

they will reply me and suggest me what should i Do???? I have only 10 days... they will not reply me soon

So now you have 2 cases now.

1) Your case petitioned by your mother. You can send email to embassy about your confusion.

2) Your case petitioned by your brother. If your brother call NVC today, then you have one year, he can confirm this with them.

Then wait a few days to see if embassy replies, then you can decide what you want to do.

But at this stage two cases won't conflict with each other.

And the first thing you guys should do on priority is to contact NVC regarding case 2, so that you still have that option.

Your mother can no longer file for you. She has no legal grounds to file for you. Her status has expired and she never became a citizen so she can't file for you. SO you will get denied.

Yes my brother called to nvc they told him that your case is approved but your approval letter is not delivered then my brother request to change current address and contact number they said you will get approval letter within 3,working days

He will be wasting his time and money.

His mother's immigration status has expired and she has no immigration benefit to extend to OP.

Yes you are understand my situation exactly so can you suggest me what should I write in mail?

You can tell them you had an interview with embassy and that your mother is no longer living in US and her green card is expired, and she have no plans living in US(if she really don't have plans(if she have plans moving back to US the what is the prodecure?)). And ask them if you can continue with this and provide them the required documents? Or you need to file a new application? (I think you should't tell them about the petition your brother filed.)

So i should not give DNA test or further step?

My brother is Citizen in USA, He gave affidavit and supporting papers... any way to resolve this issue?

Your brother can file for you but your parents cannot.
