As marijuana is legal in a few U.S. states now (Alaska, Colorado, Oregon, and Washington) it's a legitimate question. However, it's still illegal in Texas.

So if an interviewer asks you "Do you smoke marijuana?" and you want to answer "No" truthfully, then yes, you should stop "smoking weed."

I admit, I try to answer questions without judgement or sarcasm, but this post would challenge a saint to reply without snark. Immigration is a serious business. If one can't figure out that they should not be doing drugs throughout the process, then I'm not sure any advice on VJ can help such a person.

The man asked a simple question. Whether we think our advice is helpful or CAN help a person is irrelevant. His question was simple. I don't know the answer so I have no horse in this race but if I DID know the answer, I would have answered and then HE WILL be responsible for his actions when the chips fall where they may, I think that's the point that gets missed here. Plenty of people break laws. Let him decide what he's willing to gamble as a consequence.

So if an interviewer asks you "Do you smoke marijuana?" and you want to answer "No" truthfully, then yes, you should stop "smoking weed."

Even if weed was legal in Texas, it is federally illegal, they aren't immigrating to Texas, they are immigrating to the US. Texas isn't processing their AOS, the federal government is.

Want to know if I should stop smoking weed or not.

It's legal in some States for recreational use. I think it's unlikely that they'll test you but if they do you could try to claim you only smoked when you visited somewhere like Colorado? They may be suspicious about that though.

I didn't say that it WASN'T federally illegal. With all the news stories about the legalization of marijuana even though it is still illegal federally, I can see where he might be confused about the laws.

My main statement was that if an interviewer asks him if he smokes marijuana, and he wants to answer "No" truthfully, that he should stop smoking it. My answer was about the possible question and answering truthfully. I had no opinion on whether he would be denied if he said Yes to that question.

Considering weed is legal in certain states, I do wonder if there are exceptions regarding the medical.

Personally, I would stop and not even consider touching it ever... Depending the types of tests done, further testing could be conducted to conclude prior results in more detail. You know it stays in your system a while and how things are concluded varies on the test done.

There's no medical done for a greencard, that's done prior to actually obtaining some form of status. If adjusting from k1, then k1 is the medical. If CR1 i assume so, but no idea. AOS there's no medical it was already done on k1. Just figure out when and where your medical will be.

As far as we know zero exceptions. Cr1 has the medical done in home country. K1s only redo medical if it takes you longer than a year to aos.

The answer is NO. There is no drug test at an AOS interview. That said, you should stop smoking weed.

Yeah I am past the K-1 stage. We got married and I submitted my medical already for the AOS.

Now I am just waiting for the interview for the green card.

I didn't think there was any medical for the green card, which I why I smoked some in the first place.

But I will stop until I have my green card, just to be safe.

The reason I asked VJ was just to be sure.
