Hello,

My fiancé and I are about to submit our application for the K1 visa. However, I am submitted to the 2 year home-country physical presence until october 2016 - 7 months ahead. Since the application takes time to be evaluated, we figured we could start gathering all the information necessary for the petition. With that, if we apply at the end of this month or earlier march, in october I will be actually able to get the visa.

Our inquiry is: Is it actually okay to submit the application still being subjected to the 2 year-rule in this case?

We have read this forum and saw that the actual visa is just provided at the interview, so that is why we started prepping everything, and just wanted to make sure this move is okay.

They evaluate whether the 2-year home requirement was met at the actual interview and not before.
