Getting a copy of the I 94 would be the first step.

CBP records absent an I-94 are enough to prove a legal entry; an I-94 is certainly preferable, though.

Maybe she is from Mexico and entered legally but they just waved her in??

I seem to remember a Board of Immigration or Circuit Court of Appeals case that dealt with exactly this situation you wrote. The board or court considered it to be entry with inspection.

The case I remember was where there was evidence if the wave through, otherwise everybody who entered without inspection would just say they were waived through.

It goes without saying that there must be some sort of evidence of entry despite being waved through hence the 'legal entry' referenced by calliliving.

yeah exactly! i think it was without inspection and i read somewhere this happened and they got a visa? Where is the OP from? and what border did she enter from?

15 years ago you just had to flash an ID.. 99% of the time they wouldnt even look at Canadians IDs and just wave them through.
