I have a question and am hoping that you all can help me with. I am a US citizen living and working in Thailand and have recently files an I-130 petition for my Thai wife. Once approved, she will apply for a IR1/CR1 immigrant visa. The I-130 petition is currently under review and as of this moment we have not heard anything back.

After many years of living and working abroad my employer has asked me to return to the US and the company headquarters. I am fortunate to have a very understanding employer and they have asked me to return to the headquarters only after my wife has the proper immigration visa. So until we are all approved we have no definitive plans to move out of Thailand.

My concern/question is regarding a visit to the US with her (we both live in Thailand). I have to make a trip back to the US for business as well as to a little vacation with family. My wife has a valid 10 year B1/B2 visa (in her maiden name and new passport referencing old) to visit the US and has done so with me 5 or 6 times. We will be in the US for about 1 month total and will be returning to Thailand.

My question is with the I-130 petition filed, can my wife go with me on this trip to the US using her B1/B2 (expires 2024) without affecting the process to obtain a IR1/CR1 immigration visa? We do not want to disrupt, delay or ruin the process by making a trip that is not advisable. Thank you in advance for helping to clarify.

Yes.

She may need to show proof that she will return to Thailand, but that's unlikely.
