Experience with SECOND Filing, Different Spouse?

Yes…I am going through this whole immigration process all over again.

In 2000, I did not go through the K-1 process, but via the I-485 adjustment of status for my now ex-wife as she was already in the US on a different visa. We had no problems with the whole process. She was approved. After our 2nd anniversary we filed the form to remove the "conditional" on her permanent resident card and that was approved too. Everything was great until our marriage broke down and we ended up getting divorced.

It has now been over 2 years since my divorce and I am engaged to another woman from Mexico. I am filing the K-1 visa and sending the normal plethora of documentation/evidence/photos attesting to our relationship. Even though I have all the required documentation, I fully expect to get scrutinized beyond belief as I’m sure I will be red flagged for this being my second Mexican wife.

My questions are:

Has anyone gone thought this process a SECOND TIME with another spouse?

If so, what have been the timelines, experiences and end result (approved/denied)?

Any insight would be greatly appreciated. Thanks.

I think the only thing that might slow you down is IMBRA - but since, from what you said, this is your first, rather than 2d, K1 application, you should face no more scrutiny than anyone else. Perhaps some extra questions later on, but no legal bars that I can think of.

As long as you can prove that your relationship is a bona fide one, with plenty of evidence of having met in the past 2 years, plus pictures, boarding passes, telephone bills, emails, etc., you shouldn't have any problems.

This is your first filing for a K-1 visa, your other marriage was under different circumstances.

I would just make sure you provide all the documentation asked for, and you shouldn't experience any more problems than anyone else.

No IMBRA implications as this would be at best only a second filing and it is outside the two-year lookback.....

This is my second K-1. Like you my first marriage ended in divorce. My applications was not delayed any longer than those going through it the first time. From what I have noticed is that there has not been any real disruption since IMBRA. Hopefully that will continue.
