My husband is EWI and currently lives here in the states with me. I know the application will get denied, but it is my intention to later file a waiver if reform doesn't pass.

I just want to make sure that I'm filling these out correctly. I know that I have to be honest, so when I fill out his current address, I would put our address where we currently live, right? The same for his current employer? (Since he obviously doesn't have authorization to work)

My friend is doing the exact same process, but having an attorney file for her. The attorney recommended that she do not put his actual current residence down.

For the Biographic info form (G-325A), Do I fill out 4 duplicates for me, and 4 for him?

You have to file 4 X G-325A for him and 4 X G-325A for you

As for the address, Id be honest, but that's just me..

What application will be denied? You are asking about a petition? Why will that be denied?

I suggest that you slow down for a few and get some more information. There is an excellent forum with many EWIs in the I-601 section of the forums at www.immigrate2us.net

They will have more experience with the residence address question and can help you understand what gets denied when.

Hiding his true residence may be a material misrepresentation, an additional burden you do not want to have to overcome.

The I-130 will not be denied because he is EWI. The I-130 petition is to show your citizenship (USC) and your relationship to your beneficiary (spouse).

His visa application, when he eventually makes it, might be what you are thinking about. It will be denied (he will be outside the US at this point) and there is a waiver you can apply for to overcome his inadmissibility.

Clearly, there is a lot more to it than that. I really recommend the immigrate2us site--many people have succeeded in the circumstances you face. If Laurel told you about the process, I'm sure you've got it down.

Laurel told me to file the I-130 and to sit and hope CIR passes, since I really dont have much hardship to prove and there is not a high approval rate for waivers from Brazil.
