Passport Name Change after Annulment in Philippines

Good evening Visa Journies:

My name is Sun. I am bright and full of warm light. Hehehe. It is nice to meet you. Please help me because I am very confuse about what I am to do. English is my fourth language and please be patient and so kind. Hindi sapat ang isang lengguahe lamang :-)

I get a annulment in October 2015. Waiting still for PSA to give CENOMAR and annotate MC. Hay nako! SOON.

I am excited to change to my single family maiden name. I wish to not be with the married name anymore. My American fiance will do I-129F soon for us.

1. Should I get new passport in maiden single name before we files the I-129F? (my present passport is in married name and expires in 2020)

2. Some friends say I cannot get new passport with maiden name because my present passport won't expire for four years. Should I claim it lost or broke?

3. Will new passport with maiden name affect K1 visa interview and I-129F? All of our evidence of meeting has old married name

4. Is CENOMAR from PSA needed to change passport name for me or can I do it with certificate of finality and annotated MC from LCR only?

5. I will get a new postal ID in my maiden single name soon also

Please be very helpful. This is important to me to know. Many clean details you can give will help me understand better. Thank you in advance to you all.

This is just based on my own personal experience. I am not anymore familiar how passport system is in the Philippines but way back 2010, I got annulled too and had my passport ( old passport with my previous married name be changed and reverted back to my single name ) it was never a problem. All they ask was the Annotated marriage contract and court annulment document. I did not wait until the expiration of my old passport.

We did this prior to the I-129 filing. So far, everything went smooth. No problem whatsoever with my new passport.

The easiest and less confusing for everyone is to leave everything the way it is during your visa processing. Then, once you are married change everything to reflect your new name including your passport. As long as you have your certificate of finality and annotated MC from LCR for any questions along the way you will be fine. If you go this route just be sure to book your travel tickets in the name that is in your passport.

It's a small price to pay, hanging on to your "old" married name, but in the long run it will make processing so much easier. Good Luck

If you name will revert back to your single name after everything is finalized and you have your new annotated CENOMAR, I would get the passport done to match your name AS IT IS NOW. I would not wait until later as some suggested. You can get your new passport while waiting for the I-129F petition to be approved, as the passport won't be needed until actual visa application time at USEM.

If you wait until after you're married to change your name, you're probably going to be stuck with your ex's surname as your new middle name. That's the name that will be on your green card. Then, when you update or renew your passport at the Philippines Consulate in the U.S., you'll probably still be stuck with your ex's surname as your new middle name. It's best to change your name now.

My wife was "divorced" (yes there is a form of divorce in the Philippines) in the Philippines and she never changed anything and she was able to process without a problem using her "ex's last name" and also receive all her correct documents with name changes after our marriage with her maiden name and my last name for her surname. No problems with ROM at Philippine Embassy Washington DC. So it can be done the way I explained in my original post. I also concur you could probably do it the way Hank described. You will not have to take your ex's surname as your middle name. You select your name when you apply for your marriage license and certificate. From that point forward you use your name as spelled out in your marriage certificate and you will have no problems. Also, no problems with SSN either.

1. Not every state allows you to change your middle name upon marriage.

2. When renewing your Philippines passport or getting a new Philippines passport after reacquiring your Philippines citizenship, the Philippines consulate will issue the passport with your surname from your previous marriage as your middle name. They also have an option of issuing the passport in your maiden name. In both cases, you can reconcile the difference between the name on your Philippines passport and the name you are otherwise using by getting a document from the Philippines consulate called "One and the Same Person".

Very true. Some states only allow for changing the last name, thus it is wiser to use your current legal name for the visa process, including having your passport in your current legal name.

Hello all,

 

I would like to seek some advise my husband and I are married last April 2015.

 

My husband is US citizen, he was divorced here in US to a filipina but they never informed the Philippine consulate regarding their marriage. Last year, I tried to renew my passport to be change under my husband surname. But I was denied due to my husband birth was Philippines, he got his US citizen by Naturalization. We were advised to have his marriage annulled in the Philippines. He was here in US since 5 years old, its been a while he return in the Philippines and such hussle process just to renew my passport?

 

I only have 1 year validity of my Philippines passport and I'm currently in the process of my removal of conditional greencard will take 8 to 12 monthhs processing. My concern is the timing while waiting to receive approval 10 year greencard to the expiration of my Philippine passport.

 

Is there a way I could just used my old information status in the Philippines? Will my Philippine passport be renewed?

 

Any inputs highly appreciated.

You can ALWAYS renew your passport in your maiden name even if your married po. Before we did the ROM for my asawa she wanted to go down to LA to see if she could "fix it" to where she could renew her passport with her married name. They told us that "she has to do the ROM first before they can renew the passport in our married name, but she can always just renew it in her maiden name if she wanted it done".
