Hopefully this is a good place to ask this question. My co-worker from India is on an H1B in the US. He has his H1B endorsement in his passport, and now he is going to apply for a visa to Canada. This will be somewhat work related as we make occasional trips to Canada to have meetings with the other half of our work team that resides there. When we cross we just state we are going to meetings and will only be there for one or two days. While there we do not do any physical work, or anything that would require a work visa. My question is should my Indian H1B co-worker apply for a Canadian work or tourist visa, so he can accompany us on these trips?

This is mostly a US immigration forum. But it seems like since you do make these work trips, he should go to the Canadian embassy and apply for a work visa. He's going with the intention to meet coworkers for business meetings which constitutes work.

I'm confused. You say the trip would be work related but that your H1B co-worker won't actually be doing any work while in Canada.

This is a question for your HR/Legal department. If they go through the hassle of actually getting H1B visas for their workers, then they're probably going to be very interested in assuring that a "work related" trip of one of their employees is legal.

Thanks for the opinions. I agree with applying for a work visa, and will pass this along to my co-worker.
