URGENT: I have applied for the adjustment of status but am very close to the 90 day period of my k1 visa expiring, I have received a letter that says USCIS has received my adjustment of status application and is going to process it. They also mentioned that the biometrics screening will be the next step but no biometrics appointment letter was provided just yet. I was wondering what document or letter would basically tell me that I no longer have to worry about the k1 visa expiration since my adjustment of status has been "accepted." If there Is a phone number or any website I can visit that will help me in my query, I would appreciate it greatly. Thanks!

Yes, there is. The letter that OP received, called a NOA1. It proves that he or she has filed for AOS. Because of that he/she is authorized to stay in the US until the AOS application is adjudicated.

I agree with EM_Vandeveer, the NOA1 (I797) is proof of filing the AOS. To the OP, there is no timeframe to apply for the AOS. The K1 was voided when you entered the US, and from there you are authorized to stay for 90 days to get married. As long as you met that requirement, which apparently you did, and now have filed the AOS and received your NOA1 you are fine, and in a period of authorized stay in the US (not subject to deportation). Just relax and be patient for the upcoming biometrics appointment, and resolution of the AOS.

Good info. I have a question. My Visa "issue date" is Feburary 16th 2016 and it says "expiration date" as June 16th 2016. Does this mean I have to travel and get married before that date? I have not traveled yet and plan to travel in end of march. I am confused a bit. can you please shed some light. Thank you.

You need to enter the US using the K-1 visa before the June 16th expiration date. Once you enter the US, you will have 90 days to get married.

As KayDeeCee said, the visa expiration date is only related to travel and entry into the US. The 90 day clock does not start until you actually enter the US. So in effect you have six months from the date of your K1 medical exam (this date determines the expiration date of the K1) to actually enter the US on that visa, then you have 90 days to get married.

As KayDeeCee said, the visa expiration date is only related to travel and entry into the US. The 90 day clock does not start until you actually enter the US. So in effect you have six months from the date of your K1 medical exam (this date determines the expiration date of the K1) to actually enter the US on that visa, then you have 90 days to get married.

Your K1 visa became invalid the moment you arrived into the US. It is a one time, single entry. The expiration is how long you have to use it, the one time. Your NOA1 letter is your legal presence in the US for now, don't lose it. If you applied for EAD and AP, those should come in about 2-3 months. Your green card somewhere there after. You can travel outside of the US only after you have your AP card or green card.

Judging by recent approvals and AOS timelines you should have recieved your biometrics letter within the first month of NOA for your AOS. If you did file for your AP/EAD you can file an online request for the EAD after 75 days, that being said I would maybe make an info pass to find out why you haven't recieved your biometrics appt. I'm not really sure when you sent AOS based on your question.
