CSPA

Concerns for children (aged 23 , 24)

My brother applied a F4 visa for me in March 2003.

Got approval letter in june 2010.

- Me, my wife and four children.

At the time(nov 2015) of Ds230 i paid fee for only 2 childrens.(aged 23,24 not included) the online forms says the other 2 are not applicable.

I then called NVC to include the names of my 2 childrens that are not included.

They told me to wait for case to become current and then we will decide at that time whether to allow them or not.

I have received an interview call/letter from Islamabad embassy on Feb 1st.

But the interview letter only had names of me, my wife and 2 younger childrens only.

As they arent in the interview letter do they are not included in the medical as well.

I contacted NVC again and this time they said please bring all your children to the embassy they will run CSPA at the time of interview.

Please advice.

Are they eligible for the visa (aged 23, 24 no ds230 fee paid for them)

how old were they at the time of filing I-130?

how old were they at the time of approval of I-130?

looks like your approval took 7 yrs. 2003 to 2010

so subtract 7 yrs from your child age.

then add 5 yrs ,because you had to wait 5 yrs to visa to be current.

if they are still fall under 21 yrs age ,they qualify.

D O B

15 july 1991

20 june 1992

I think it was in june 2010 when my case was approved

so child #1 is 25 yrs old

child # 2 is 24 yrs old

subtract 7 from their age your I-130 approval waiting time

they fall under 21 yrs child category. assuming your visa priorty date is current.

F3 Category India

Priority Date November 05, 2004

Approval date: April 29, 2010

DOB: Feb 06, 1993

Date Visa Bulletin became Current: March 10, 2016

Does she qualify for CSPA. The case was complete without her name so I called NVC and they put it under CSPA review. How long does it take for CSPA review by NVC?

Hello,

I have filed for my sister (F4) I-30 petition. Priority date is August18 2003. She has daughter who turned 21 last year (oct 2015) but before she turn 21 we got welcome letter and visa fee invoice and her name was there. We paid visa fee and filled DS-260 and submitted other paper work before she turned 21. Now we are waiting for visa and only a month away but this month (May 2016) there was no changes in priority date. It seems they will retrogressed, possibly as early as June. This could be an issue possibly.

Also, I am confused on approval date when counting CSPA. Is that the NOTICE date written on approval notice? If so then our case was approved within 7 months and that is why the concern is

Will she still be eligible to get visa as all the paperwork is done on behalf of her and visa fee is paid? Also, will they consider this retrogressed time as its not her fault?

Can you please share your experience of of the CSPA process.  My family members are in the sane boat. Were you kids able to get visa at the same time?
