How would i do that? I never expect this and he doesnt care to me at all.

If you DID NOT suffer from domestic violence, then you have no way to stay in US legally.

K1 visa holder can only adjust status through the original petitioner.

I would suggest that OP see a lawyer about this since this situation is more complicated. They may be able to better advise you.

Please see a lawyer as they are more experienced with the law.

This is a do it yourself site and you're in a more complicated situation than most.

A lawyer may be able to find a way for you to obtain legal status.

Her AOS was denied and the USC divorced her afterwards.

So the CHOIN VS. MUKASEY case does not apply to her.

I read it as it was denied and then the petitioner withdrew which I assumed meant they didn't appeal it but, I may have misunderstood what OP meant.

Maybe I'm wrong I would just assume thats why it got denied.

The key thing po is that you need to know WHY YOU GOT DENIED FOR AOS. That is the big thing here. If you got denied because they thought you married just for a greencard then you have to go back to Pinas because there is no way for you to stay here. You also need to talk to your asawa and find out if he actually got a annulment or divorce.
