Hi, can i apply for social sec and work permitt if i got denied from uscis. Then my husband have a possibility that he divorced me. He left me with nothing. Can i petition myself instead? Please help. I got here dec 2011 and got married feb 21 2012. Thank you

If you DID NOT suffer from domestic violence, then you have no way to stay in US legally. K1 visa holder can only adjust status through the original petitioner.

Her AOS was denied and the USC divorced her afterwards. So the CHOIN VS. MUKASEY case does not apply to her.

You came on a K-1, your sponsor withdrew the I-864 and divorced you. There is no way for you to remain in the US legally.

Did you adjust your status when you got married?

I adjust status as soon as we got married but after interview mail received and denied and my husband withdraw his petition. He left me 2014

I didnt receive any divorce papers. Coz i moved..he just told me he filed annulment. Its been years now i dont know what to do.

So you have no legal status in the US now?

I guess..

What have you been doing since 2014? How do you support yourself?

I see...so basically, the marriage didn't work out which is why I'm assuming he also withdrew the petition once it was denied.

The only way I see you would be able to petition yourself, although it's been so long since you entered the US, is if you suffered from domestic violence but I dont think it applies for K1 applicants.

Couldn't see get the divorce papers and use then along with evidence of she enter the marriage in good faith and then adjust herself or has it been to long?
