can somebody please check that when the embassy invite us, would I have aged out? or I can go as per CSPA ?

Also, would be glad if formula is mentioned

Hi,

It took USCIS about 9 years, 8 months, and 14 days to approve the I-130. That time is not counted against you, so your CSPA age will be under 21 until you reach the actual age of 30 years, 8 months, and 14 days.

Since you did not mention a category, I will assume you are a derivative beneficiary under the F3 or F4 categories where the PD you mention would not be current under the March 2016 Visa Bulletin. With a March 2006 PD, you are unlikely to age out when it becomes current. The PD should become current in the next few years.

Formula for aging out from Child Status Protection Act

  • CSPA allows the time a visa petition was pending to be subtracted from the beneficiary’s biological age at the time of visa availability so that the applicant is not penalized for the time in which USCIS did not adjudicate the petition
  • MEANING, the longer the wait for approval, the better for aging out people, in your case almost 9 yrs will be subtracted ,once visa number available.so till you are 30 Yrs ,you will be under 21 yrs in eyes of NVC.

CSPA

Concerns for children (aged 23 , 24)

My brother applied a F4 visa for me in March 2003.

- Me, my wife and four children.

At the time of Ds230 i paid fee for only 2 childrens.(aged 23,24 not included) the online forms says the other 2 are not applicable.

I then called NVC to include the names of my 2 childrens that are not included.

They told me to wait for case to become current and then we will decide at that time whether to allow them or not.

I have received an interview call/letter from Islamabad embassy on Feb 1st.

But the interview letter only had names of me, my wife and 2 younger childrens only.

As they arent in the interview letter do they are not included in the medical as well.

I contacted NVC again and this time they said please bring all your children to the embassy they will run CSPA at the time of interview.

Please advice.

Are they eligible for the visa (aged 23, 24 no ds230 fee paid for them)

When was the I-130 approved? This information is needed to determine if CSPA may help your children.

F4 . My cspa age is 20 year 9 months.my PD 25 june 2003 approval date 20 th july,2009 from march PD is current Today my name was added back with my father now status showing Follow to join in front of my name .Others family members civil documents sent and under review Please tell me how to solve and next steps and status follow to join in converting accompany
