For a self employed person can I simply bring my IRS Transcript from 2005? I can also provide current copies of checks and invoices with company check stubs attached that equal well over 50k for 2006 and current 2007 checks that are already over 30k. I just have not done my 2006 taxes yet.

Also, question about GROSS or ADJUSTED GROSS- would it work if I were to bring:

2005 (IRS Transcript) $45,000

'04 was $23,000 but the adjusted gross was just 19,000 and

'03 $70,000

Again, I worry about '04- it was a slow year. Is that 125% above poverty? I am sponsoring her- its just the two of us.

THANKS!!!

I was told that transcripts are fine. Also, here is a link for the poverty guidelines: http://www.uscis.gov/files/form/I-864p.pdf

According to that information, if there are just two of you, you only need $16,500, which is well below your 2004 income. Even if you needed more, I heard they average your income over the three years, and also consider any assets you have (savings account, for instance).

Sounds like you're fine there.

As far as the 2006 taxes, I'm with you - not exactly done yet. I was wondering if it's okay to just fill one in even if it hasn't been submitted yet. I have a few questions on how to do it because of a few unusual (for me) situations. I'd like to send one to USCIS, but ....... I don't know. Maybe I'll file with the IRS now because of the AOS, and do an amended return later if I realize I didn't do it right. I wonder what that will do with our application, though......

Let me know if you hear from anyone else about the 2006 taxes. We're going for an InfoPass appointment tomorrow, so maybe I'll have a better answer for you afterwards.

Good luck!

I went ahead and sent my 2006 taxes along with 2005 even though 2006 was lower because of expenses - I'm self employed. Figured one less thing for them to RFE me for. Didn't send 2004 because it was the lowest. We are relying on assests fo $43,000.00 to get us approved as my income is short of poverty guidelines.

I sent my AOS in a couple of weeks ago and didnt include my returns for 2006, for me or my cosponsor. I only submitted my W-2 for 2006 for me (I only worked the last 3 months of 2006 and havent worked before then because I'm a full time student) but not a return because I hadnt filed it yet. I submitted the 2003, 2004, and 2005 returns of my cosponsor and her W-2 for 2006. I included a note saying that I wasnt including the returns for 2006 because I hadnt filed yet, but that I was including the 2006 W-2s. I guess we'll see if I get an RFE. :)

On the RFE we received, it mentioned something about submitting an extension to file instead of the actual tax return, so that might be an option for you.

We weren't able to get any more information during our Info Pass appointment today, though. The woman said not to worry about the RFE, and kind of hurried us out the door.

Hope this helps somewhat!

Best of luck.
