what visa do i need

My boyfriend is a US citizen and we have been together for 3 year, i lived in the US for about 4 year when i was a minor. My dad was arrested for almost a month and declared innocent. He was liberated and his tourist visa was given back to him. At this time he decided to stay and live in the US due to fear. I came back to Mexico about a year ago because i wanted to go to university and was unable to do so in the states. When i tried to come back in to visit, i was detained for about 6 hours and my visa was cancelled. I'm currently living in Mexico but me and my boyfriend have decided to marry. We are both 19 and going to school, I recently got a job here so we can pay the expenses of the migration process and he is not working at this time. So my question would be if i am eligible to become a permanent resident or am i not?

Did you leave before you were 18?


Either way YES you can become an LPR either through a K1 (fiancée) visa or getting married and the CR1 (spousal) visa.

I'm just trying to figure out if you have a ban or not so what kind of waiver you may need if so.

How old were you when you left.

Did you leave before you were 18?

I'm just trying to figure out if you have a ban or not so what kind of waiver you may need if so.

i left just after i was 18, when my visa was taken away they said it was cancelled but i could get another one anytime that i didnt have to wait a certain time.

So you did not live in the US, you were visiting.

Your B became void as soon as you overstayed, they probably said you could apply, getting one is a totally different issue.

yes i dont think i could get a tourist visa again. but can i get a k1 even if i overstayed or not?
