SB-1 elligibility after many years

Dear Sir,

I want to know if I am eligible to apply for SB1 visa.

I had got Green card in 1988 with no expiry date when I was a child of 10 years through family sponsored Greencard by my paternal uncle .

I had to return back with my parents as there were some family problems and I could not go back afterwards as I was still a child.

I had applied for business visa few years back and therefore had to return Greencard.

Now if I apply for return resident ,am I eligible to apply.

But I saw that people who were minors and had no control of returning back can still use SB1 visa to return .Wanted to confirm though.

Timeliness was nearly same but that person did not return GC,does it matter.cause it would be considered expired anyways,right?

Also wht if the SB1 is rejected,then applying for non immigration visas would become a problem as they would consider that I am doing so to for immigration purpose only.

SB-1 returning resident visas are for permanent residents. You explicitly abandoned your permanent residency and returned the card at the consulate. So how do you think you are eligible?

My green card was already expired as I had not travelled to US for a long time.If I had to travel for company work,I had to go for Business visa ,to avoid any issues at POE ,my travel agent appointed by company asked me to surrender the Greencard on the same day when I had my business visa interview .

My spouse is here in India so I cannot try for Spousal visa either.

Have you not come across such cases where child is minor and could not travel back on Greencard but wants to go on SB1 now as adult and it is approved.

Yeah,same scenario like mine ,Greencard through family ( parents and that person)and applied for SB1 later.Not through spouses.
