Hi,

I am Permanent resident since 2012. Filed tax from 2008 to 2014. Moved to india in 2014 and currently living there. Got married in 2015 to a indian citizen. I have filed the GC petition to my spouse and got it approved recently.

Since I have been working in India for the past 2 years, I neither have any income (from US) nor I have any payroll from US. However I am employed full time in india and have have payslip from indian company. In this case, how should I go with affidavit of support. Will indian income be accepted for affidavit of support or what would be the alternate options (though joint sponsor should not be a problem), but the challenge being me not having any income in US. Appreciate your time and help, Thanks

A few questions

you are a green card holder, you are still required to file taxes on your world wide income, and therefore would need to file taxes for 2015-not due yet but keep it in mind

you have been out of the US since sometime in 2014, are you sure your GC is still valid?

It is rare cases where foreign income will be acceptable for the affidavit of support, will this income continue when you are in the US? It is very likely you will need a co sponsor

Thanks much for the reply.

I have filed taxes till 2015 with world wide income.

I have got the re-entry permit valid till 2017 (assuming this will keep my GC valid, else let me know if I am wrong?)

I have my friend in US who is willing to co-sponsor, but the only confusion is that, will NVC accept the co-sponsor for full sponsorship considering I have nil income for 2015.

However I have tax returns (ITR) and W2 from US employment from 2008 to 2014 which has income reported 20 times more than the minimum required for sponsorship.

Current and continuing income is what is evaluated. If your Indian income would not continue when you returned to the US then the joint sponsor would be needed. The prior years' income wouldn't matter.

So will NVC accept the joint sponsor covering the "full" coverage. Is there any clause that me (primary sponsor) should cover some part before joint sponsor can cover the rest.

Another scenario/clarification :

If I travel back to US in 2016 (before further processing of my wife's petition) and get employment in US, will that help as evidence for affidavit of support.

As long as the co-sponsor's income is enough, you need not show any income. But you still have to file the I-864 even if your income is zero.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
