K1 RFE requires court records and worried

Hi everyone,

I'm a newbie. I wanna share my story here because I'm kind of worried and I don't want to put my emotions on anybody especially on my fiance.

Here is my story. Me and my fiance met in our last job in Shanghai China where we were together for 13 months. Then he went back to the U.S. for his master degree in UCSD. We are still doing our long distance relationship but we keep seeing each other every three or four months... Well, we applied for K1 VISA on Dec 12, 2015 then we got NOA1 on Dec 21,2015. Then on February 1st, 2016, a RFE for court records is required. My fiance was in possession of alcohol. And all FIVE of them. He got the court records from the court today. So we are planing on deliver the package tomorrow including his last visit after we applied and also the flight receipt of his coming visit. We have quite strong proves for our relationship. I visited his hometown twice. And we got pictures of us every time we went on trips both in China and U.S.

My questions are:

1. Since our case is dealt in CSC, how long does it usually take to get the NOA2 after we reply RFE tomorrow?

2. My fiance has a graduation ceremony in the middle of June. Do you guys think I can get approved in time so I can join his ceremony?

I know it's useless to worried but I'm really time sensitive! I've got my notarization done and his dad is willing to be our financial sponsor. So... please advise.

Personally, I wouldn't add more things to the RFE than what it asks for. I.e. if it asks for your fiance's court records, then send the court records but nothing else. You can bring more evidence to the interview if you want.

So are you worried that his police record is gonna mess up the visa or that you won't be there in time for his graduation? I know criminal history is a little different when you're doing the K-1 but I seriously doubt possession of alcohol is gonna matter in your visa process. It's just a small delay for when you respond to the RFE, which is again why I wouldn't send more than is being asked.

Sept 15th 2015 - Request help from Texas US Senator Cornyn and his team


Sept 23rd 2015 - Our case is moved from supervisor review to NVC's team for dealing with Senator requests


Nov 4th 2015 - CASE COMPLETE!!!! :dancing:



Embassy Stage


Dec 16th 2015 - Medical exam


Dec 21st 2015 - Interview


Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license

Agree, why send more then they ask for don't get that? The tickets you can bring to the interview, they didn't ask for more proof of you guys seeing each other.

IT would be very close. Figure another month for NVC after NOA2 and the two months or so for the Embassy and to get to the interview.

The reason I add more things is mainly because it does no harm to my application. His last visit happened after we applied for K1 visa. What's more, I checked on VJ that says a lot of people even get a 2nd RFE which requires more evidence of the relationship. That's why I don't want to do all over that again. It's only three papers tops. So... :)

Hmm... We just agreed to ask his dad to provide the tax record early. So he can bring it to me on March. And I'll try to cut every break that might delay our application. Thanks a lot for you help!
