hello everyone ,we are preparing our AOS packet ,my questions are regarding filling out i-864,my brother in law filled tax jointly and her wife will sign i-864a

question part 1: am i the only joint sponsor, or should i check i'm the first and my wife is second?

question 2: we just file 2015 tax jointly so should we list our 2015 income on most recent tax year or 2014(since they will not count 2015 income before 15 April 2016).

question 3: i'm petitioner i just worked one month in 2014 so did not file taxes,so in most recent tax year should i just put 2015 income and send them explanation why i did not file tax?

I am confused about who you are asking about. Who is immigrating? Who are you? What is this brother-in-law's role? If you are petitioning your wife, then you would fill out an I-864 and you would put "I am the petitioner" on your I-864. If your current household income is insufficient, and you are using the brother-in-law as joint sponsor. Then he would also fill out I-864 and he would put "I am the only joint sponsor". His wife may fill out an I-864A to add her income to his household income if his own income is insufficient.

If you have filed your 2015 taxes, then you can use your 2015 tax return and "total income" information as the most recent year. If not, you can use 2014's. You need to send the explanation if you did not file for any of the three years.

thank you for reply, i am petitioner ,i did not make enough so i can sponsor my husband but my family they are willing ,my brother in law he filed tax jointly .in 2014 tax return he made around $17k alone and his wife she made more then him around S20K. now they filed tax return for 2015 . he made $30k alone and his wife $24k. his wife she is willing to combine her income but do not want to be main joint sponsor.NVC will not accept 2015 tax return until 15 april 2016.so in this case should we stick to the 2014 tax return and make his wife to sign i-864a? or we can submit 2015 tax return.?

What matters most is his current income (the salary that he has right now). If that is enough, then it shouldn't matter that much what it said on past tax returns. Also, I believe that you can use 2015 tax returns as the most recent year's tax returns if you have filed (you don't have to until April 15, but you can), though I'm not sure if somehow NVC is different on this.
