Hello

We have been married for 6 years now and for one reason or another we had not file for my wife citizenship , she has her renewed 10 yrs green Card .

my question is

Should we file as her having at least 5 years as PR or as we have at least 3 years of marriage with a US citizen ? as she met both requirements

I am inclining to file as having at least 3 years of marriage but want your opinion..

If you file under the 5-year rule then you don't have to provide all the other documentations with regards to marriage to a USC (joint returns, financials etc.).

The only priority is the filing date -- not whether or not you file based on marriage.

as I think would be priority if married to a US Citizen ?

The general opinion is that if you have the option between 5-year residency application and marriage-based application, go with the 5-year one since it requires less documentation and fewer questions asked during the interview.

it make sense and seems much simpler , I am assuming the interview would still request IRS filings , we have file Married jointly since we got married and she is a stay at home Mom ,

Would she need me in the interview?
