Hello all!

Michael here USC currently living in Guangzhou, China for the past 2 years. Never thought I would ever petition for a K1 visa, but life is full of surprises!

Really appreciate the members and what you guys are doing for this community, the wealth of information helped me gained a lot of insights into where to start.

Anyways, I am looking into the K1 visa and have a couple of questions. I have not proposed to my SO yet, but planning on our upcoming April trip to Thailand.

1. Since we want to cut our processing time, is it ok to mail the I-129F now? instead of waiting until I actually get down on my knees to propose in April and Then sending in the petition?

2. I currently live with my SO together in Guangzhou, when I mail in the I-129F do I mail from Guangzhou directly to the Dallas lockbox?

3. Since my SO needs a sponsor and my tax filings of $10,000 yearly won't be enough, how much savings/assets is considered enough to be a sponsor?

4. My SO applied for a Tourist Visa B1 back in October and was denied, will that have any affect on the K1?

5. I cannot do a DCF can I? I am confused with the 6 months residency of it, I've been in Guangzhou for the past two years, but I am on a China Tourist Visa. When the 90 days is almost up I exit to HK and reenter China.

Thanks in advance all!

-Michael

Don't matter you can file now

2. I currently live with my SO together in Guangzhou, when I mail in the I-129F do I mail from Guangzhou directly to the Dallas lockbox?

Yes

3. Since my SO needs a sponsor and my tax filings of $10,000 yearly won't be enough, how much savings/assets is considered enough to be a sponsor?

4. My SO applied for a Tourist Visa B1 back in October and was denied, will that have any affect on the K1?

Why was she denied? It shouldn't have an effect unless she got denied because of overstay or drugs or something like that

5. I cannot do a DCF can I? I am confused with the 6 months residency of it, I've been in Guangzhou for the past two years, but I am on a China Tourist Visa. When the 90 days is almost up I exit to HK and reenter China.

DCF is for spouses. The process for K-1 is pretty fast right now

Thanks in advance all!

-Michael

Welcome to the forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thanks for the reply Georgia16!

I will gather everything and file asap. We tried to go visit my family last Christmas in USA, the reason were all the same, they deny if they think someone has immigration intentions for the tourist visa.

When I fill out DS-160 if it asks if she had applied for visa before i will have to state it and that she was denied right?

Sorry for the dumb questions

Thanks again!

Another thing,

Would mailing directly from Guangzhou the best way to go? As opposed to emailing everything to a family member in usa and tell them to mail it for me? I guess cost wise?

Thank you!
