Hi Everybody

This is my first post and I am really freaking out, any help would be greatly appreciated...

I sent AOS status for my spouse in january and I just received a request for initial evidence.

The problem is that for 2014 I was self employed and my income on my tax return didn't meet the guidelines, I only made $15000 that year. Since July 2015 I have been employed as a server and I have made around $15000 in 6 months.

I submitted with my AOS a letter from my employer saying that I was making between 32000 and 35000 in a year , and I also submitted all my pay stubs for 6 months but apparently they haven't accepted it because they are stating on the letter that my income doesn't meet the poverty guidelines.

I am really confused about what my next steps should be....

Should I just send everything again with 6 months of bank statement, my W2 and a letter of explanation?

what happens if they think my response to request of evidence is not sufficient enough? Do they deny you?

I also made a mistake and listed wrong income on form I-864 could that be part of the RFE?

submit a new I-864 with income evidence proving your current income claim (along with all other required documents). That evidence is typically an employer letter and several recent paystubs.

I did submit 6 months of pay stubs and a letter from my employer already... should I send it again?

so you do think that even though My tax return doesn't show enough I could be approved with proof of current income?

or is there still a chance of denial?

Have you already filed your 2015 taxes? If so, obtain the transcript and list that as your most current taxes as well as submitting last 6 pay stubs and updated employer letter and I-864.

Current and continuing income is what they want to see for a wage/salary earner. If you can get your 2015 taxes done and filed then send a copy of that tax return as well.
