No Social Security number, USCIS delays with EAD (I-765)

I came on a K-1 visa with the intention of marrying then my fiance. We married on the second day of my arrival in the country primarily because its not in our culture or religion to live with the fiance unmarried. Waited 6 weeks for marriage certificate so that I could apply for adjustment of status. In all of this hullabaloo, I did not apply for a social security. When I went in 2 weeks after I had gotten married to my local SS office, I was told that my K-1 visa was no longer valid as I had married my fiance. And that I needed to wait until EAD until I could get one. *I wish somebody had told me about this!*

Long story short, my EAD application has aged more than 90 days and I have raised a SR on two occasions. The first one was when the EAD matured 70-75 days and received a letter from USCIS acknowledging that they had received my SR and that due to work load factors unrelated to my case, USCIS anticipates a delay in completing my case. No time line was mentioned at all. The second SR was raised with no receipt of a response from USCIS (i went on online forums and read that if you call in earlier than a month, they say you need to wait until 30 days after SR.

its been 4.5 months and counting and i have no SS, drivers license, bank account, Green card, EAD. Thank you USCIS for making immigration even harder than it is!

I have written a letter to my Senator Barbara Boxer 2 weeks ago and haven't heard back. My local Congressman of the district i belong to does not deal with immigration problems.

This is really ridiculous! Anybody else in my boat? Any suggestions, recommendations would help! Thank you :(

It sounds like everything revolves around the EAD. Other Cali petitioners have said they can't get a CA DL as K-1, and we haven't come across any wall with my husband having no SSN. (Although we wanted to have one when he got here.) I was able to add him to my health insurance, bank account and he's attending college.

When did you apply for your AOS? Did you submit you EAD/AP at the same time? Did you get any RFE's? Have you tried calling the mis-information line after the 90 days has passed? What did they say?

Many people have been getting their EAD's within 90 days in October, November and even a few December people have been approved. Whatever delay there may have been, it could have passed by now?

I applied for EAD/GC/Travel Parole at the same time. When I went on the DMV cali website they said they need a SS number or they will not process my application. I am on my husband's health insurance via my I-94 number which is assigned to K-1 applicants, so I am sorted there! I can't have a bank account anywhere in CA or enter a college without a SSN. The bank managers have told me so and colleges as well.

Yes, two SR have been raised, as I earlier iterated one was 70-75 aged, other over 90 days, no responses yet for second SR. NO RFEs.

Your CA DL would probably have expired after your I-94 anyhow, so you didn't lose much there. Have you called back to inquire of your second service request? You may need to look into scheduling an InfoPass.

I'm going through the exact same thing, mine was received and filed November 6, 2015.

As many people in this situation I'm sure, it's been hard living on one income while I've been sitting home or volunteering, because I want to work and be paid but I literally cannot.

Two Weeks ago I put in a request for information, and they sent an email saying it's being reviewed, I rang the office last Friday since I still haven't heard anything and they told me to wait another 30 days as well.

I'm beyond annoyed, they admitted it was over processing time but to just wait.

I contacted my lawyer and he will get on to a senator to see if they will help. I hope they do, it's so ridiculous to have been out of work for six months not by choice.

And without a EAD, it makes getting the other things difficult, mentioned above such as SSN and licence etc.

I got my AOS/EAD/AP NOA1 on nov 27th had had biometrics Dec 23. Im still waiting for NOA2. I should have gotten it in the last week. I have a job waiting for me to start so really frustrating. I called yesterday to expedite it and I havnt yet heard back.

I hope I get approved in the next 2-3 days otherwise im screwed.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Boxer has an immigration liason human there - you have to use a telephone and call in and find that human. once you get that human, get their email address.

then send over a signed privacy release statement found on boxer's website, as an email attachment, along with your inquiry. then follow up using a telephone 2 days later - view it as a first contact about your problem.

Just 'emailing' without doing the above gets you absolutely nowhere.

Yes, I did submit a privacy release statement however I struggled finding a human immigration liasion, which a simple phone call should help. Thank you for slapping some sense into me, i would indeed need to follow up with them. If it leads to no where, I could still do something about it

For anyone in my position, I called their Oakland office and was told that my application has not had a case worker assigned yet, so its been lying in their office for two weeks now. I inquired how much further time would require to review my case, it would possibly take 2 more weeks. :(

I received one of those at the beginning of February after I submitted for a review.

A week later, still hadn't heard anything so I rang USCIS. They told me I need to wait up to 30 days from that email saying it was under review to get a response.

It's such ####### because it's already over processing time, yet they still won't look at it and we have to wait longer.

I contacted my lawyer who contacted a senator to get it looked at.

I haven't heard anything yet and it's been a week of that.

Soon enough it'll be 30 days from filing for a review and I'll have to call them back up anyway cos of not hearing anything.

So ridiculous.

I hope yours comes soon.

eh - that wording tells me it was a service request, with the 'outcome' of the service request.

for those of you with job offers plus financial hardship without working, there's a topic floating around about how to expedite an EAD - try the advanced search tool when logged in from a PC.
