Filing I-130 with new married name or maiden name?

I'm a LPR (female) and just got married to my foreign spouse. In our marriage certificate, I changed my last name to my husband's name. However, I have not changed any document (including SS card, green card, passport, driver's license) to my new name and I do not intend to do so for another year or so. I am filing a I-130 for my husband and I'm not sure whether to use my new last name to file or my maiden name.

Can someone please let me know how to go about this? Thanks in advance!

I believe you have to file under your married name and definitely do a name change in all of other documents that will be pertinent to your petition. It avoids confusion.

04/05/16- USEM Interview=221G re:NBI clearance-addition of misspelled name in marriage certificate as an AKA for wife :shocked:

04/19/16- Mailed new NBI clearance with AKA via 2GO

04/21/16- 2GO document out for delivery to USEM

04/22/16- Case touched, still AP

04/27/16- CEAC status changed ISSUED :dancing:

04/30/16- Visas on hand!!!; ELIS fees paid

05/03/16- CFO done: Immigrant Data Summary detached in all visa packets :ranting:

05/06/16- Visa packets and passports returned to USEM via 2GO

05/10/16- Visa packets received at USEM

05/13/16- Resealed visa packets received

Use your current legal name. If you changed your name through marriage then you ought to update your documents accordingly. Some may be required by law to be updated.

As your journey progress, proof will have to be shown to prove the union. documents such as joint bank accounts, rental lease with both your names on it, your name change etc. Remember the NVC WANTS TO SEE THE MARRIAGE AS A REAL UNION.

My suggestion to you will be to change your name now so it wont arise any questions later that could cause a delay. Do your homework by searching and reading other people stories and what they faced during their journey. my husband and I studied what documents maybe asked of us at his interview and nothing was missing. However they asked for a verification receipt from the high court in his country as proof that his divorce had been registered. This 221(g) tied us up for 7days and cost hundreds of dollars. So cover yourself ahead of time to stop a delay
