Bonda Fide Marriage Documents when filing I-130 for my spouse who lives overseas

Hello,

I am preparing two I-130 packages: one for my wife, and another one for our 2-year old daughter. They both live in Mexico and I live in the United States. I am a U.S. citizen (I was born in the States), but both my wife and daughter were born in Mexico. We are still confused with the documents they ask for a marriage couple to proof that their marriage is bonda fide (picture compilation, joint bank account statements, joint lease agreements, etc.). Do we have to submit this documentation at the beginning of the process (by beginning, I mean when we send both I-130 form packages)? Or, should we wait and show this information when my wife goes to the interview at the National Visa Center?

I will really appreciate it if someone could help me out with this.

Yes, you will need to provide this evidence for your wife's petition when you initially submit the I-130. http://www.visajourney.com/content/i130guide1

Have you tried CRBA for your daughter? It seems like at the time she was born in Mexico, you were a US citizen so she would qualify for CRBA meaning, a US Citizen at birth http://mexico.usembassy.gov/eng/eacs_report_birth_abroad.html

There are other requirements for CRBA though, one being that you must have physically been in the US for at least 5 years, 2 of which had to have been after your 14th birthday.

Thank you for the info. We will then have to gather all these documents to prove the bonda fide of our marriage when we send our first packages. About our daughter, I did read the requirements to try the CRBA way, but I don't meet one of them. The thing is, I lived in Mexico since I was 8 years old, and just recently moved back to the States last year. So because of my time spent in the U.S. before my daughter's birthday, I don't meet this condition - which you could read in the following link:

This is why I am going to petition for her as well.

Ahh, I see. Yes, in that case you'll need to petition for her as well. You should read the guide as to what documents to include for her petition as the father here:

Best of luck!
