Hi there,

My NOA2 for EAD and AP was Nov 27th.

I know the timelines are not fully accurate but im expecting NOA2 in the next 2 days. Looking at some comments, I could be waiting longer, its just really pot luck.

Now I have a job offer to start sometime next week but everyday that goes by, this looks less and less likely. Im not sure how flexible they will be on pushing back the start date past a certain time.

My question is, is it worth putting forward an expedite request today or tomorrow? I dont want to ruin any chances of it being looked at in the next few days, but if I dont put a request and then it turns out it was delayed, I might be kicking myself next week. I know I have not yet waited sufficient time, but I just really need to know about EAD for my job.

Any advise?

Thanks

We filed in October, around the 8th, with first notification on the 15th. Because we were looking at traveling during Dec, I got worried and did call in to expedite the AP/EAD.

You are at a funny place (EAD/AP is usually about 65 - 70 days, max 90, might be a bit slower due to Xmas/NYE/MLK holidays), and I don't see too big of a benefit to calling due to the following: expedite might shave a few days off, or might not be useful at all, as you are already close to getting via the normal timing, and USCIS would more than likely send you another request for evidence (that your job is upcoming/necessary/whatever).

That said, it can't hurt to call to expedite because the expedite request should not interfere with the normal timing. When you do call, say you are requesting to expedite due to financial loss (which it is), as your job is expected to start soon. Usually the agents are decent and will take your info over the phone, but like I said, you'll probably get an email (if you provide your email) and snail mail saying to post/fax job information. I'm not sure what information specifically, as when we expedited it was for other reasons.

We were in a similar place as you (close to the 'normal' processing time) so to be honest, I don't know if the expedite did actually help us, or if we just got it in the normal amount of time. But like I said, it didn't seem to slow it down.

October 7, 2015: Sent AOS Pack
October 15, 2015: NOA1
October 29, 2015: RFE (due to wanting more info regarding tax returns)
November 5, 2015: Biometrics taken
November 17, 2015: RFE Response Received by USCIS
November 23, 2015: Filed for Expedite EAD/AP
December 2, 2016: Approved EAD/AP
December 8, 2015: Received EAD/AP
Sept 26, 2016: USCIS received renewal for EAD/AP

Oct 19, 2016: Interview scheduled for Nov 22, 2016

Nov 22, 2016: Interview - went well but RFE for an updated medical I-693

Dec 1, 2016: USCIS received the new medical I-693

If you really think an approval is coming so close, I wouldn't expedite now, because every time you make some kind of request they pull your file back to review it and deal with the request. Do you already have approval showing online and you are just waiting for the hard copy NOA2? If so, then maybe demonstrate that to your potential employer and say that you will bring in the EAD the minute you receive it.

Thanks. Well thats what im thinking. Give them a few days as I know its been busy and with Monday off due to presidents day. However, I dont want to miss the opportunity to expedite if it turns out to be a longer wait for regular EAD approval.. I think I might wait 2 more days, see what happens.

Thanks

Yes I really think its coming in next few days. For everything else with USCIS, we have been very lucky and everything has been on time if not early. However the EAD for me is the crucial one haha

No my status is still NOA1 - however my 1485 is ready for interview. I spent time looking at the latest EAD approvals and I dont think there are many yet from the 27th which is my NOA1 day so in truth it *should* be in the next few days. I might just wait it out a bit longer and then submit Expedite.. I just hope my employer are ok waiting an extra week or two.

When were you supposed to receive your EAD? People usually get it after 75 days to 90 days based on NOA's date.

Did you contact USCIS to inquire about your case? You can do it online: https://egov.uscis.gov/e-Request/Intro.do

I red some people inquired about their petition and received their EAD after 2 weeks. I guess sometimes is just a matter of which file they work on first...

I'm curious to know how you got a job offer without EAD? Is it a job in your field and was it easy to obtain without your EAD in hand?

Im on 84 days since NOA1

I called them to expedite but will also send the request info to them now.

Yes it was a job in my field and the employer felt I was the right fit and was happy to wait until I get EAD (which I explained to them) - however I now have to tell them its going to arrive a bit later.

If your employer understands your situation and is willing to wait longer, I'm sure your can still have this job. Hopefully it won't take too long.

day 75 you can put in an official inquiry. Expedited requests need a good reason to jump the queue. Maybe obtain writing from your employer and use that as evidence of a job offer. You may be able to claim hardship then.
