I recently got laid off from my job on L1 status, with 3 dependents on l2 status.

We are transitioning to B2 status immediately in order to tie up our affairs but there is a problem...

In an oversight, my five year old daughter has overstaryed her L2 status (her passport expired before her visa, and we hadn't realized that the L2 had been dated with the same date as her passport expired). the passport has been replaced, we were advised at the time that as long as she had the visa in the expired passport as well as the new passport, there would be no problem.

Are there any options? Can my daughter return to origin country (UK) and re-enter on a valid B2. I know non-status can not be changed from within the US.

Any advice much appreciated!

She could certainly apply for a B2 on the London consulate.

Do not know if she attends school but that can not be done on a B.

Overstay precludes VWP.

But if you are leaving anyway going back for a visa seems a bit of a waste.

hey Boiler thanks for the quick reply. We had been considering the B2 as a "stay of execution" so to speak, with a view to getting under an E2 blanket. within the next 3 months. My daughter is 5, in Pre-K (which we pay for privately)
