USC less than 2 years in UK

Posted this in CR1 forum but no response - can anyone help with their experience or advice ?

We filed I-130 early January and because the London website said that if the USC was less than 2 years resident in the UK, they should file at their last place of residence in the US..

So we filed Nebraska - they sent it to California who mailed it back to us in the UK saying file in London

We filed in London who sent it to Nebraska who sent it to California

After waiting one month for NOA1, Carolyn rang California.

They sent NOA1 to Wisconsin (old house) and it was returned to them.

They have put the file in freeze one month ago and not contacted us even though ALL our forms have the UK address..

They will not process afile unless they can serve the NOA1 notice in the US !

So now London will not take our case and California will not unfreeze our case unless we live in the US

This means that a US Citizen living less than 2 years in the UK and not having a US address cannot do a I-130 !!!!

help !! THIS CANNOT BE SO !

Can anyone help with what happened to them or what we should do - we are STUCK !!!!!!

How do other USC's resident in other countries who cannot do DCF manage to get an NOA 1 ????

That is crazy!! I'm actually feeling pretty angry for you guys. It's just not right. Why the heck wouldn't they contact you at your UK address?

We were thankfully accepted at the London office. I've heard that they tend accept the petition when the USC has been in the UK for 11 months or more, and I've had 19 months.

Do you have any family member's address in the states that you can use?

well i suppose we could use Carolyn's mother's address but she isnt too nimble nowadays and it would mean her sending everything on to us at the visa stages later on....

It would probably take ages to find out whether we would need a special form and whether we would get in a pickle later on when they realised Carolyn did not live there

But it can't be right can it , that a USC citizen in the UK since last October is not allowed to file in the UK or in the US..

Surely it can't be so - that US Citizens living abroad, (those who cannot do DCF) are not allowed to file at all ?

just doesn't sound right....

2 months in and both USCIS offices are refusing us...

when we came to the UK it took us 20 minutes in Chicago to get a UK green card - now we are over 2 months into this and cant even get them to start the case or send a letter of acknowledgement even though they both know about it - we really are in a shell hole in no man's land and nobody can help- Carolyn tried to get the supervisor in California uscis to help, but his English was so bad it too him several minutes to be able to understand our very short, very common name. After that he just refused to send the NOA1 outside the US and said the file would remain frozen...

I called London this morning but nobody would discuss it

I understand your concern with her mother dealing with the mail, but as far as I'm aware there's no problem with using the address if your wife is not currently living there. You can very reasonably say that's where you intend to live when you immigrant until you establish your own residence. I don't know how you'd go about getting the NOA1 released to that address though. Maybe just ringing again and saying that you'll be staying there for a bit when you immigrate and want to use that address for processing.

I understand your concern with her mother dealing with the mail, but as far as I'm aware there's no problem with using the address if your wife is not currently living there. You can very reasonably say that's where you intend to live when you immigrant until you establish your own residence. I don't know how you'd go about getting the NOA1 released to that address though. Maybe just ringing again and saying that you'll be staying there for a bit when you immigrate and want to use that address for processing.

Its worth a try if I can't get either office to move...!

At least we are with California who are processing faster than Vermont.... our noa1 date (we never got an NOA1) is 12th February so I am hoping for 20th May-ish for NOA2....we rang and they promised an NOA1 which never arrived- then we sent a letter which was not acknowledged... at least we can see the case on the website so we hope it is still rocking along...

It's a big worry all the way through - I have a friend who got their petition approved and then the file was lost at the visa stage at New Hampshire and it was a case of start again ! So I cant feel confident until I get the passport stamp at the point of entry- still hoping for November but its a squeeze

However at least we are together and having done K1 in the past, I know that a separation situation is far worse...

just posted a new topic in IR1 forum - have a look see- and hoping someone has had a similar message and can de-cypher it for me...when I got noa2 for k1 it said this petition has been approved - this one has some of the same words but it is so cryptic ! why can't they be clear ? oh well fingers crossed this is NOA2..if so then its good news for you as it will maean california are moving fast but i can't believe it until someone who has had the same message can confirm it...
