Hi All,

My fiance and I will be married this week in the US (she's been here for 1 month). I am working on the i-485 document to have it ready once we are married. My fiance's two children eligible to join us as part of the K-1 Visa will not be joining us until the school year ends (July 2016). Knowing that, I am not sure how to fill out the Part 3 section, B of the I-485, it asks for my info (the spouse & US Citizen) as well as my fiance's children. I am including all her children (4), but of the two that are eligible to come over within the year period, should I be checking off the box that says "Applying with you"? I know for me and her other children, the answer is "No", but wasn't sure about her children that will join us later.

Thanks for your help,

Charlie

You cannot adjust status for a person who is not in the US.

The I-485 is completed by the beneficiary, you don't list your (petitioner) children (from past marriage), you do list her children, even if they are still in the Philippines.

Part 3, B : SHE lists her children, then check the NO box because they are not filing with her at this time.

Thanks NLR & Hank,

That's what I did. Just entered her children and checked NO for all. Appreciate the fast replies.
